24 Hour Fitness Class Action (CALIFORNIA GYM ONLY?) Deadline to join is 2/26/18

This case is about the scum tactics used by this gym's sales counselors who are worst than used car salesman; especially at the end of the month.

They tricked members into paying large sums of money upfront (Prepaid Membership 2-3 years), then said that on the 4th year and FOR LIFE!!! The annual renew fee will never increase.

Fast forward and they did raise the annual renewal fees for about 65-70% of their loyal members despite what the sales counselors said. You never received the back of the contract and it's fine print. Only the front of the contract tucked into a small plastic holder until you got your real membership card.

Deadline is 2/26/18 and members should be getting notification in the mail

You must take action to preserve your rights. Don't sit back and accept the default claim. The default claim is that they can raise your rates in 3 years.

For some people, you can get a refund.

If your Annual Renewal Amount has been increased, it will revert back to the initial annual renewal amount plus refund of any increases, and you will be entitled to renew at your initial renewal rate as you as you remain in good standing and pay timely.*

Important: To secure this benefit, you MUST submit a valid claim form and declaration EVEN IF YOUR ANNUAL RENEWAL AMOUNT has not been increased.

*My warning to you is to set up an online account, WRITE ON YOUR CALENDAR WHEN YOUR MEMBERSHIP RENEWS AND PAY ONE MONTH BEFOREHAND. PRETEND THESE PEOPLE ARE LIKE THE IRS AND NEED THEIR MONEY.

I am sure that many "renewal" bills will suddenly get lost in the mail.

True scum of a gym. No pride in any upkeep of equipment. They goal is to get you packed in. At my local club (SUPER SPORT), there is nothing SUPER about it. Dirty, tiles chipped in shower, pool dirty, tvs on machines don't work, etc.

First they had basic clubs with UNLIMITED access to all the clubs. To lock these members out and to try to extract money from them for upgrades, SPORT was created.

So if you signed up for SPORT, you now have UNLIMITED access to all the BASIC AND SPORT clubs. WOW!

Then the SUPER-SPORT was born to lock out the SPORTS people. Want to go to SUPER-SPORT, give us more money! My SPORTS club was converted to a SUPER SPORT in 3 days. Just add towel service, nothing else.

Then the ULTRA-SPORT was born to lock out the SUPER SPORTS people. Want to go to ALL CLUBS? Pay more money!

This company dislikes their customers. They are not in the health business. They are in the money business. I am surprised this company is not lower rated than banks, cable providers, and DMV.

Hmm...... that FAQ seems to have at least one error. Wink

"19. What happens if I do nothing at all?

Answer:

If you do nothing, you will remain a Settlement Class Member and, depending on the status of your Prepaid Membership, will receive the relief outlined for Settlement Class Members who do not submit a Valid Claim Form and Declaration as described in Part B under Question 6, above."

That should be "in Part B under Question 5, above." There is no "Part B" under Question 6, it's under Question 5. In fact, Question 6 tells you to go look at Part B of Question 5.

I've had good experiences with them. Yes, it may not be the cleanest gym in the world and the occasionally squeaky treadmill drives me insane. But they did not raise my annual like other people got raised and they do have a grace period if you forget to pay. A fairly generous one, I think it's like 2 months. They have also never failed to send me a physical email renewal. Regardless, online they let you know much sooner longer before your renewal date.

It's strange, you seem to detest them so why are you fighting so hard to stay a member?

Regardless, I would have posted this in Hot Deals or at least Deal Talk. I think there are plenty of members that need to file this to ensure their rates don't go up in the future. Finance gets little traffic. Ask the mods to move it.

B. Settlement Class Members who do nothing, i.e. do not submit a Valid Claim Form and Declaration are entitled to the following benefits under the Class Settlement. These benefits are not included in the Government Settlement, so if the Class Settlement is not approved, 24 Hour Fitness may raise your Annual Renewal Amounts at any time and the below increase limitations will not apply.
• If you are currently a Prepaid Sport Member and you have not yet received notice that 24 Hour Fitness is increasing your Annual Renewal Amount, 24 Hour Fitness may increase your Annual Renewal Amount as follows: The first such increase may not exceed $45 per year above your Initial Annual Renewal Amount and may not be further increased for the next two (2) consecutive annual renewal periods, so long as you timely pay the Increased Annual Renewal Amount and any applicable taxes and remain a Prepaid Member in good standing. 24 Hour Fitness may increase your Annual Renewal Amount thereafter in its discretion.
• If you are currently a Prepaid Super-Sport Member or Prepaid Ultra-Sport Member and have not yet received notice that 24 Hour Fitness is increasing your Annual Renewal Amount, 24 Hour Fitness may increase your Annual Renewal Amount as follows: The first such increase may not exceed $90 per year above your Initial Annual Renewal Amount and may not be further increased for the next two (2) consecutive annual renewal periods, so long as you timely pay the Increased Annual Renewal Amount and any applicable taxes and remain a Prepaid Member in good standing. 24 Hour Fitness may increase your Annual Renewal Amount thereafter in its discretion.
• If you are currently a Prepaid Member and received notice that 24 Hour Fitness was increasing your Annual Renewal Amount, you are entitled to renew your membership at the Reduced Annual Renewal Amount, plus any applicable taxes, for the next three (3) consecutive annual renewal periods, so long as you timely pay the Reduced Annual Renewal Amount and any applicable taxes and remain a Prepaid Member in good standing. 24 Hour Fitness may increase your Annual Renewal Amount thereafter in its discretion.
• If your Prepaid Membership was terminated after notice that 24 Hour Fitness was increasing your Annual Renewal Amount, you are entitled to reinstate your Prepaid Membership by paying the Reduced Annual Renewal Amount, plus any applicable taxes. Your Annual Renewal Amount will not be further increased for the next two (2) consecutive annual renewal periods, so long as you timely pay the Increased Annual Renewal Amount and any applicable taxes and remain a Prepaid Member in good standing. 24 Hour Fitness may increase your Annual Renewal Amount thereafter in its discretion. To obtain such relief a Settlement Class Member in this category must check the box requesting reinstatement in Part III of the Claim Form and Declaration, and 24 Hour Fitness will send you an invoice with instructions for payment of the Reinstatement Payment, which you must pay within ninety (90) days from the date of the invoice.

So, I was promised $49/year for life after 3 years prepaid. They raised it to $99/year a few years ago. I already filed to get my money back from the increase. Are you saying if this class action suit fails, they can raise my rates are any point? Didn't they really do that already?

Y'all really need to lookup the lifetime fitness founder's membership settlement that screwed ppl that joined the class. Don't assume that you will benefit please!

Are you saying that we should not submit the claim for 24 hour fitness? I also received a form in the mail. My annual renewal was $29/year, but was then bumped to $79/year evetually.

As I see it, this case doesn't resemble the one for the Lifetime Fitness one. If you read the FAQs, it tells you how to opt out and the benefits for participating. Already preliminarily approved by the courts. 24 hour fitness can always balk and pull out of the agreement, then we can go to courts over this. I filled out my form via email so they can't claim it was lost in the mail. I also said, "Yes, I will testify if needed to."

Case Status
The Court preliminarily approved the proposed settlement on December 14, 2017.
Because the settlement has only been preliminarily approved, the settlement is not yet final.

A hearing on the request for final approval of the settlement is scheduled for June 1, 2018 at 9:00 AM, at the United States District Court for the Northern District of California.

24 Hour Fitness has agreed to provide various benefits to Settlement Class Members as outlined in Parts A and B, below.

A. Settlement Class Members who submit a Valid Claim Form and Declaration are entitled to the following benefits:

• If you have a Prepaid Membership and you already paid Annual Renewal Amounts that were increased above your Initial Annual Renewal Amount, and you submit a Valid Claim Form and Declaration, you will be entitled to:

(1) a refund of any amounts you paid above the Initial Annual Renewal Amount listed in your Prepaid Membership plus applicable taxes if any, and

(2) renew your Prepaid Membership at the Initial Annual Renewal Amount, plus applicable taxes if any, in the future, as long as you timely pay the Annual Renewal Amount and any applicable taxes and you remain a Prepaid Member in good standing.

I haven't comb through the documents and I am not an attorney but I don't think they can raise rates by "applicable taxes." For example, towel tax, water tax, facilities tax, etc. The language would have to be surcharge.

I don't see how we could be worst off by joining this lawsuit.

I received this in the mail although all the 24 hour fitness's in AZ were bought out by LA Fitness. I originally had a $79/yr rate and now pay $119...I'm still very happy with my rate and it got raised to $119 a year or so before LA fitness took over and has been there ever since

anyone have any idea how this works in the above scenario with LA fitness? I don't want to mess up my grandfathered membership, even at $40/yr more than what I originally paid...LA fitness knows I just pay the same rate for life...new member rates are $30-35/mo without much wiggle room on anything but the signup fee...if I can get some money back from 24 hour fitness though, that would be nice

A couple more days before the deadline. Just looking through my documents that I received in the mail.


There are 4 sections.
Section 1: Prepaid member information
Section 2: Declaration / Family Add on Declaration
Section 3: Request Reinstatement
Section 4: Request declaration to be sent to primary member for family add-on prepaid membership.

Because I initially signed up for myself, it looks like I only need to fill out section 2, just the declaration, but not the family add-on because there wasn't any family add on.


.... But I'm curious about section 3. I didn't get terminated, but I simply paid $79.00/year as opposed to my original $29.99/year fee. Do I still check the box?


Check this box if your prepaid membership terminated after receiving notice of an increased annual renewal amount and you wish to request reinstatement.

24 hour fitness will send you an invoice with instruction for payment of the reinstatement repayment, which you must pay within ninety (90) days of the invoice date. If you also complete Part II, you will be entitled to reinstatement at your initial annual renewal amount. If you do not also complete Part II, you will still be entitled to reimbursement at an amount that will be provided on the invoice, which will be sent to you.

Did anyone get any kind of confirmation after submitting their forms?

What are you suppose to use as proof of your participation in the settlement, in case they do increase your fees later?
