Because the franchise doesn't give a f*ck about franchises or their costs. To baskin Robbins it's just building brand recognition and loyalty at the cost of the franchisees.

I can't believe BR advertises these "free samples" Half the stores don't even know about it and if they do the sample is tiny

They should give each store a handful of tubs, for free. Then in return, expect the franchisees to give free scoops out.

Maybe they do, maybe they don't. However, what you describe as "building brand recognition and loyalty" is something any business would want, even with both franchises & franchisee's. Yes, many franchises will put promotion costs on the back of the franchisee, but you can't deny that it's an advertising cost and does bring in foot traffic. What is hard to quantify is the cost/benefit of the promotion.

It's not easy or cheap to bring in new customers! It requires advertising! Besides, if the franchisee did read the entire franchise agreement and fully understood the obligations, it likely gives license for the franchisee to take actions such as this.

What did the franchisee expect? Use the brand name for a one-time cost? If they don't like the terms, they can open up their own ice cream business under their own name. It's a free country the last time I checked.

Personally, I'd be wary to enter into a franchise agreement before researching the type of business, talking to other franchisees and a lawyer who specializes in such business entities. Never trust the salesman when making such a big financial decision!
