No they can't. You are also not putting ATT SIM in it. BB is just selling you the phone with a phone plan, once you are out of the store they don't care. ATT can flag you but that's unlikely.

If you are being asked passcode for cancelling the account and you don't have one and also you can't set one as the 2 factor phone number is not active going to an ATT store is the best course of action. They can send the code to an email and you can cancel the account there.

All of my credit reports are locked...if its a soft inquiry then it won't require me to unlock so I will see and report back.
Port your Google Voice number out to another carrier
To port your number out of Google Voice, first you need to unlock the number. Then, let your carrier know you want to port a number to their service. Work with them until the porting process is complete.
When you unlock your Google Voice number, it costs $3 USD. But if your number was originally ported in from another carrier, there's no charge.
On your computer, open Google Voice.
At the top right, click Settings and then Settings.
Go to the "Account" section.
Under the Google Voice number you wish to port out, click Unlock.
Complete the payment with your Google Account.
Ask your carrier to port your number to their service.
If successful, at the bottom left, it displays "Number unlocked."
Most people won't fall under this umbrella, they just regular people looking to upgrade their phones that they've probably be using for years. The majority of people doing this are more than likely not going to do this again anytime soon(atleast with ATT). Also there are so many other networks offering simmilar deals. Verizon for instance is offering the same promotion in store.
Doing something like this once every couple of years, won't get anyone banned.
That being said majority of the people here would never touch ATT service with a 10 ft people especially considering the vast ammount of alternative services that are infinitley cheaper.

2. I never received any other email from ATT to set up my account - the ATT website is not recognizing the email address for account setup, that I confirmed in response to their email verification request
