I guarantee these are brand new grey market products.
I've bought a few things from 6th Ave. and they are "reputable" in you will get what you paid for... But they do the scammy shit like call you on your phone to ask if you want an extended warranty or even a non-grey market, fully supported product for X amount of dollars more.
Some stuff I've bought like my old (D750) was sold as new, but clearly was split from a combo package that originally was packed with a lens.
Likely selling it as "refurbished" just so they don't have to deal with customers that expect a new product.
TL : DR, They aren't a scam, but they do slightly shady tactics to try and upsell you.
I received the lens in two days ordered it on Friday and it was delivered by Fedex on Sunday. Brand New in box. I updated the firmware and appears to be working perfectly. I'll test it out this weekend's shoot. My conformation email from Ebay indicates I have until 9/7 to start a return. I'll shoot like crazy to make sure it's a keeper. Thanks SD.

How do you like this lens? I'm considering doing the same and selling my 27-70 f/4 to finance this one. I'm wondering if I'll miss the 24-34mm range. Family events, portraits, and maybe some travel is what I plan to use it for. (I know it's heavy!) Thanks for any insight!
