Macy's is running a background check on my 6 year old child, is that legal?

1,685 1,186 February 9, 2011 at 09:19 AM
So this past christmas my 6 year old was hurt at macy's when a display shelf came crashing down.

Today is the 1st time they contacted me.

The wanted to know about a car accident we had 3 months ago.

How the hell do they know my 6 year old was in a car accident unless they ran a background check.

Any ideas?

And no trolls, I'm not looking for legal advice, I'm looking for the database that Macy's used to check on my child.

Thanks!

If a traffic citation was issued, it's public record.

Not without her consent, they didn't. That's a HIPAA violation and someone would be going to jail right quick like.

There's more to this story you aren't telling us. Did you indicate the injury to them and is there any dialogue regarding compensation? Did you sue?

They obviously are doing due diligence to protect themselves against an injury claim that may not be caused by the falling shelf but by other accidents.

Plus, they also asked about a slip and fall at mcdonalds last year, she was not injured and we just let it go.

Now how the hell do they know about that if a claim was never filed?

Yes the macy's store manager filled out a report and yes, my child did have a brusing on her arm and shoulder.

Today is the 1st time they contacted us.

During the time of the Macy's accident, did you vent, "first the McDonald's slip, then the car accident, and now this"?

A "slip and fall" at McDonalds?

"Let it go?"

This leads me to believe you contacted someone in management because your 5 year old fell down. The local businesses probably have constructed a database to protect themselves from... dubious... claims from you.

From an injury that happened only a little while beforehand?

That's odd.

Wow little kids hurting themselves who would have thought and the reason you dont need the legal advice is because you have researched this throughly after the first incident of litigation right.

i think I understand...

child = meal ticket by means of litigation.

I agree with whoever else talked about Macy's doing their own due diligence. It appears warranted from the details I've gleaned from what OP has provided in this thread so far.

Please correct me if I'm wrong and provide some additional details.
