Fresh & Easy in El Segundo fined for charging more than posted prices

SAN DIEGO - A judge has fined the owners of El Segundo-based Fresh & Easy stores for charging more for items than the posted or advertised prices.

San Diego County District Attorney Bonnie Dumanis said Tuesday the judge ordered Fresh & Easy Neighborhood Market Inc. to pay $833,136.

Superior Court Judge Randa Trapp also ordered stores to offer consumers $3 off the lowest advertised price if they are overcharged. If the item is $3 or less, it will be free.

Prosecutors in San Diego and Riverside counties filed a civil complaint alleging the company posted advertised prices in stores and then charged more at the register.

Prosecutors also say meat and seafood were marked higher per pound than the shelf prices indicated.

The company says the mistake was unintentional and it has taken preventative measures.

Didn't see this anywhere. The Hefty One Zip bags are a good deal at Ralphs this week.

They're part of the buy 10 get $5 off.

Makes them $.99 each.
Buy 10, use 4 of the $1.50/2 (11/11RP) & 1 of the $1/2 (1/6RP1)
= $2.90 + tax or $.29 per box.

I noticed that the ad for Albertsons is not valid for two locations, Long Beach 2nd Street and Wilshire Blvd in Santa Monica. I also noticed their store hours are now 8 to 8 at both locations which normally means a store closing. I have not been able to dig up anything online tonight about Santa Monica. Anyone know for sure if it is closing? I have not seen any announcement of that location closing unlike the well known Long Beach closing.

Update: The Albertsons at 3105 Wishire Blvd. in Santa Monica is closing for good on 2/6/2013. They are liquidating their stock now but meat, produce and dairy are gone already. It will become a Bristol Farms. http://www.smdp.com/changes-are-acomin/115823 This was originally a Lucky store location.

Just got this email from Fresh & Easy:

Thank you for being a Friend of Fresh & Easy. We wanted to reach out to you to address numerous news and online reports about the future of our stores.

Our parent company Tesco is conducting a strategic review of Fresh & Easy - they're looking at all options to find the best outcome for the neighborhood market that you - and we - have come to love. While we don't know exactly what that outcome will be, or if Tesco will continue to own the company, we're confident that Fresh & Easy can continue to be your favorite market.

We want to assure you: we don't have plans to close stores. We're still committed to providing delicious, wholesome and affordable food every day. We're still Fresh & Easy; open for business with everything that you enjoy about our store, with even more exciting things to come. That's why we're going to keep on fighting the good food fight.

Now, more than ever, we appreciate your energy in our stores and being able to share a smile with you. We look forward to seeing you soon and thank you for your continued support.

The Fresh & Easy Team
