I saw the story the other day, it was a terrible decision and the mother of the children should be investigated too for her part in this.

I think the Judges that make these types of judgement should also be investigated as they seem to sympathize with the child sex offender rather than the child victim. I wouldn't be surprised if the Judge was also a child abuser and may have child abuse pictures on his computer.

Yeah, you have to wonder about that. The flimsy excuse that the mom wants her sons to have a male role model in their lives is just crazy. What sane parent would want an incestuous rapist pedophile around their children and what sort of judge would think that's a good idea?!

I'm not wondering about the judge. I'm wondering about the "report" he relied so heavily on in making the decision. Some evaluater who treated 2,000 cases over the span of 30 years.

Right. So we all know pedophilia isn't a treatable condition so what is the success rate of the alternative treatment process? That's a good appellate issue to raise which hopefully was already raised by prosecutors. (Appellate courts won't hear certain arguments for the first time on appeal.)
