Last time I purchased a GoPhone from AT&T it came already activated and unable to unlock unless you stay with them for 6 months.

I tried, but they have a $45 restocking fee [att.com], so end up selling the phone on eBay locked to AT&T.

restocking fee sux, maybe you can open the box carefully(not to damage the shipping label) to check phone condition first.
if its already activated, just bring the box back to fedex/ups saying unknown recipient return to sender.

So if I can sell the top up for $25 or so, then this is a $5 phone, not bad. Need it unlocked to use on FreedomPop though, not sure if I want to risk it.

Unlock codes are around a buck and change on eBay.

I am gonna try this but am pretty sure it's the regular att gophone. You just don't switch it on with the att sim, that way it's not activated and does not need the 6 month min.

Pretty sure phones from AT&T (i.e., not from Walmart, BB, Target, et al) comes activated. See previous AT&T deals on SD to see for yourself.

thanks for the info,do you have a link as I did not find anything that mentions a brand new gophone being pre activated and not being able to unlocked if a sim was not inserted.

Anyways as someone mentioned it can be unlocked for a few buck.
