NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. BY ENTERING (OR OTHERWISE PARTICIPATING IN) THE SWEEPSTAKES, ENTRANTS AGREE TO THESE OFFICIAL RULES, WHICH ARE A BINDING CONTRACT, SO READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SWEEPSTAKES ENTITIES FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
The Slickdeals Daily Sweepstakes (the “Sweepstakes”) is open only to individuals who are legal residents and physically located in one (1) of the fifty (50) states in the United States or the District of Columbia and who are at least eighteen (18) years of age or older at the time of entry.
These Official Rules govern one or more separate Daily Sweepstakes. Each Daily Sweepstakes is a separate and independent promotion from any other Sweepstakes conducted by Sponsor. Each Daily Sweepstakes has its own separate prize pool and winner selection process.
Employees, officers, and directors of Slickdeals, LLC (“Sponsor,” “us,” or “we”), its parent, and each of their respective affiliates, subsidiaries, advertising and promotion agencies, distributors, and other prize suppliers (collectively, the “Sweepstakes Entities”), and each of such employees’, officers’, and directors’ immediate family members and/or those living in the same household (whether legally related or not) are not eligible to enter the Sweepstakes or win a prize.
For purposes of this Sweepstakes, immediate family members are defined as spouse, partner, parents, legal guardians, in-laws, grandparents, siblings, children, and grandchildren, and those living in the same household shall mean people who share the same residence at least three (3) months a year, whether legally related or not.
Participants cannot win more than one Slickdeals daily contest in any 90-day period. Your Slickdeals account must be in good standing, i.e., not banned, suspended, or otherwise restricted. Your email must be listed as confirmed. Unconfirmed accounts are not eligible. Usage of duplicate accounts to increase entries will result in invalidation of all entries.
By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these “Official Rules” and the decisions of Sponsor, including the interpretation of these Official Rules and its exercise of discretion, which will be final and binding in all respects.
Each Daily Sweepstakes has its own Entry Period as stated on the applicable contest page. Each Entry Period constitutes a standalone sweepstakes, separate from all others. Entries do not roll over between days.
To participate and enter the Daily Sweepstakes during each Entry Period, you must have a valid Slickdeals account. If you do not have an account, follow the steps located here to create one: https://slickdeals.net/forums/register.php (“Sweepstakes Website”). Creating a Slickdeals account is free.
By submitting your information (e.g., email address, etc.) and creating a Slickdeals account, you will be required to agree to Slickdeals’ terms of service and privacy policy. If you do not agree to these, you cannot create a Slickdeals account or participate in this Sweepstakes.
Once you have created a Slickdeals account, to enter each Daily Sweepstakes, log in to your account, go to that day’s contest, and click the Enter button. Click that day’s contest to check that day’s bonus entry opportunities.
Only eligible activity within specific forums will count toward earning Sweepstakes tickets. Threads, comments, votes and other actions made in the following forums qualify: Hot Deals, Freebies, Free Magazines, Free Digital Goods, Marketplace Deals and Deal Talk. Activity outside of these designated forums will not generate entries or tickets toward the Sweepstakes.
The database clock of Sponsor’s Sweepstakes Website will be the official timekeeper for the Sweepstakes. Those who do not follow all instructions, provide required information, or abide by these Official Rules or other instructions of Sponsor may be disqualified at Sponsor’s sole and absolute discretion.
Entries generated by script, macro, or other automated means and entries by any means which subvert the entry process are void. All entries become the property of Sponsor and will not be acknowledged or returned.
In the event of a dispute as to the identity of any entrant who submits an entry, the entry will be deemed submitted by the account holder of the email or other account from which it was sent, provided such person is otherwise eligible. Winners may be required to show proof of being the registered account holder.
A Winner will be selected in a random drawing from all eligible entries for each Daily Sweepstakes, conducted within a reasonable period after the applicable Entry Period. Odds depend on the number of eligible entries. Each Daily Sweepstakes has its own separate and independent winner selection process. Only entries received during the Entry Period for a given day will be eligible for that day’s prize.
Potential Winners for each Daily Sweepstakes will be notified by mail, email, and/or other method (as selected by Sponsor). Notification is deemed to have occurred immediately upon sending of an email or other electronic message, one (1) day after sending via a delivery service, or two (2) days after mailing.
The potential Winner may be required to execute and return an affidavit of eligibility, a liability release, a publicity release, physical address, and/or services and performance agreements (collectively, “Prize Acceptance Documents”) within seven (7) days of issuance.
If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, Sponsor is unable to contact a potential Winner, or a potential Winner is not in compliance with these Official Rules, the prize may be forfeited and, at Sponsor’s discretion, an alternate winner selected.
For physical prizes, winners must provide a valid U.S. shipping address within seven (7) days of winner notification. Sponsor will not ship to P.O. boxes, military addresses, or addresses outside the United States.
Non-compliance shall result in disqualification and award of the prize to an alternate winner. Sponsor is not responsible for late, lost, or misdirected notifications.
For each Daily Sweepstakes, one (1) winner will receive a prize as described on the applicable contest page.
No substitution, transfer, or cash equivalent except at Sponsor’s discretion. All federal, state, and local taxes are the winner’s responsibility. Prizes are awarded “AS IS” without warranty. Sponsor may substitute a prize of equal or greater value if necessary.
All prize details not specified in these Official Rules will be determined in Sponsor’s sole discretion.
Physical prizes will be shipped to winners within the United States only. Sponsor is not responsible for shipping delays, damage during transit, loss, theft, or any customs/import issues.
All physical prizes are awarded “AS IS” in new condition unless otherwise specified. Sponsor makes no warranties regarding physical prizes beyond any manufacturer warranties that may apply.
Winners are responsible for any applicable taxes, duties, or fees. If a physical prize is damaged, defective, or lost during shipping, Sponsor’s sole obligation is to provide a replacement of equal value or cash equivalent at Sponsor’s discretion.
Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, delayed, garbled or damaged entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with any Daily Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of any Daily Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by Sweepstakes Website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the Sweepstakes Website. Persons who tamper with or abuse any aspect of the Sweepstakes or Sweepstakes Website or who are in violation of these Official Rules, as solely determined by Sponsor, may be disqualified and all associated entries voided, all in Sponsor’s sole judgment. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness, or proper play, or submission of entries, or should the Sweepstakes be unable to run as planned for any other reason, Sponsor reserves the right, in its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential Winners from all eligible, non-suspect entries received prior to the action taken or as otherwise deemed fair and appropriate by Sponsor. The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email or other account to receive messages. CAUTION: ANY ATTEMPT TO DAMAGE THE SWEEPSTAKES WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR MAY DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
By participating in any Daily Sweepstakes, entrant agrees to release, discharge, indemnify, and hold harmless the Sweepstakes Entities and each of their respective directors, officers, employees, agents, successors and assigns (collectively, “Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines, or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) entrants’ participation in the Daily Sweepstakes; (ii) any acceptance, possession, misuse, or use of any prize (including, without limitation, losses, damages or injuries to entrant’s or any other person’s equipment or other property, or to their persons, including those arising from any travel to/from any prize event or activity); (iii) any claims arising from the condition, quality, merchantability, fitness for purpose, safety, or performance of any physical prize; (iv) any defects in manufacturing or design of any physical prize; (v) any personal injury or property damage caused by any physical prize; (vi) any failure of any physical prize to perform as expected or advertised; (vii) any shipping, handling, delivery, or fulfillment issues related to physical prizes; (viii) any damage, loss, or theft of physical prizes during transit or storage, (ix) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (x) any typographical, human, or other error in the printing, offering, selection, operation, or announcement of any Sweepstakes activity and/or prize. Without limiting the generality of the foregoing, entrants agree that the Released Parties have neither made nor will be in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, in connection with the Sweepstakes and/or with respect to prizes, including, without limitation, to any prize’s quality or fitness for a particular purpose. Entrants agree and that the Released Parties shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by Sponsor interruption or inability to access the website, application or any online service via the Internet due to hardware or software compatibility problems; any damage to participant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Released Parties. Each entrant further agrees to indemnify and hold harmless the Released Parties from and against any and all liability resulting or arising from the Sweepstakes and to release all rights to bring any claim, action or proceeding against Released Parties and hereby acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize supplier that may be sent along with a prize.
Subject to applicable law, Winners irrevocably grant the Released Parties, and each of their licensees, and its and their successors, assigns, and sub-licensees, the right and permission to use their name, voice, likeness, and/or biographical material for advertising, promotional and/or publicity purposes in connection with the Sweepstakes, in all forms of media and by any and all means and media (now and hereafter known), and on and in connection with related products, services, advertising, and promotional materials (now known or hereafter developed), worldwide, in perpetuity, without any obligation, notice, or consideration except for the awarding of the prizes to the Winners.
In the event Sponsor is prevented from continuing with the Sweepstakes by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Sweepstakes by any party, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. Sponsor additionally reserves the right, in its sole and absolute discretion: (a) to modify, suspend, or terminate the Sweepstakes should a Force Majeure event or occurrence corrupt or interfere with the administration, integrity, operation, security, or proper play of the Sweepstakes; or (b) to disqualify any entrant found to be, or suspected of: (i) tampering with the entry process or the operation of the Sweepstakes; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws. BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in San Mateo County, California and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to this Sweepstakes shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration,” then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in San Mateo County, California. The federal or state law that applies to these Official Rules will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in San Mateo County, California. Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of entrant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
Sponsor shall have no obligation (express or implied) to use any or to otherwise exploit any Submission or, if commenced, to continue the distribution or exploitation thereof, and Sponsor may at any time abandon the use of the Submission for any reason, with or without legal justification or excuse, and entrants shall not be entitled to any damages or other relief by reason thereof.
Because of the unique nature and scope of the Sweepstakes, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Sweepstakes. Sponsor cannot accurately predict the number of entrants who will participate in the Sweepstakes.
If Sponsor shall desire to secure additional assignments, certificates of engagement for the Submission or other documents as Sponsor may reasonably require in order to effectuate the purposes and intents of these Official Rules, then entrant agrees to sign the same upon Sponsor’s request therefor.
To receive any legally required list of the Winners, send a stamped, self-addressed envelope, within sixty (60) days of expiration of the Sweepstakes Period, to: “Slickdeals Deal Posting Sweepstakes Winners List,” Slickdeals, LLC, c/o Kiln Las Vegas, 8488 Rozita Lee Avenue Bldg 3, Suite 100. As a condition of entering the Sweepstakes, entrant gives consent for Sponsor to obtain and deliver entrant’s name, address, and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations, and rules. Any information entrant provides to Sponsor may be used to communicate with entrant in relation to this Sweepstakes or on a Sweepstakes Winners list. Any information collected from you in connection with this Sweepstakes will be used consistent with Sponsor’s privacy policy available on our website at https://slickdeals.net/content/list/privacy-policy.
The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Documents will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Documents is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Entrants agree to waive any rights to claim ambiguity of these Official Rules. Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on the Sweepstakes Website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.
