I tried ordering. They made is very difficult to have a billing address not in these areas, Finally when I did get my order through, they immediately cancelled it.

Some providers allow only new equipment. Check rebate rules. My provider doesn't say on the rebate form but the flyer says so. See here YMMV

my ecobee3 just gave up on me after 3yrs and 3 months of service. It says its calling for heat but it doesnt call for heat. Can i use this one without Alexa? just never set it up.

Same here. I really like the most recent Smart Thermostat and feel it was a big upgrade over the 3. I havent had any problems with Alexa integration.
