Unless Judge Roberts gets the notion to politicize the court by kowtowing to Leftwing criticism, AA is going down.
Justice Kennedy never voted in support of an Affirmative Action case. Roberts has shown interest in rolling back racial preferences....in 2 cases already. The Seattle and Kentucky cases. One where he stated very clearly and concisely in an opinion he wrote..."The way to end racial discrimination is to stop discriminating on the basis of race." I think AA is going down....as it should, as it never should have been law. It is unconstitutional under the 14th amendment. This has those employed (generally highly paid for no real wealth creation or productivity) in the Diversity Industry absolutely crapping their pants. Over 70 amicus briefs were filed in regards to this case. They wont be able to suck the life blood out of our economy anymore...whilst playing groups against one another and calling it shinola, any longer. The polls were not skewed, biased, oversampled or wrong. I was. There was no wave, no landslide, I was wrong about that too. Nate Silver is the gold standard of polling analysis.

we already allowed them to choose less qualified racial majorities over more qualified racial minorities. white admissions went down in ca post-aa. so sure, lets allow it. the disadvantaged are given priority regardless of their race, so its not unconstitutional.

That has been clear from the get go. That a minority group is now making noise about their discrimination (Asians) is just making headway amongst the current zeitgeist (white Euripeans can be discriminated against in favor of minorities). There is a way around this, that is the Freedom of Association. Minorities are loathe to allow that basic right be un-infringed. Notice how hard Roberts is trying to stick with precedent, instead of striking down prior AA jurisprudence and case law. I think he should push a more aggressive roll back of bad Leftwing jurisprudence from the 20th century, myself. Also of note, Sandra Day OConnor was at the court for oral arguments in this case. She was the critical vote sustaining Affirmative Action in 2003 Michigan Law School case. The one where she said that AA racial preferences/discrimination were against the spirit of the Constitution, but not the letter....noting that she hoped that her ruling was revisited and struck down 20 or 30 years in the future, but that she thought that we needed some more racial discrimination for the time being. Unbelievable. |

However, there are nuances and other aspects. Here is one: can universities consider diversity when evaluating candidates and considering their "qualifications." |

There is a difference between rational feeling that X is bad and hating X based on your prejudice and sense of resentment, etc.
For example, there are people that in principle support death penalty. They would speak in favor of DP and would vote that way. Then there are people who would go to prison fences where death row inmates are executed and open up champagne bottles when the inmate is put to death. I suspect some people would be ready with bottles of champagne when and if AA is stopped. It is sad to see this side of human beings. Sigh. |

Don't black kids understand they can't have educational opportunities until their parents get their act together?
