Trespassing? No - still a crime.
Recycling? No - that's a crime as well in most states I've lived regardless of where the bins are located. On your property it's your property, on the curb it is the property of the waste collection company and taking recycling is theft - most likely because it's money generating. I believe that is county specific for me but could be statewide.
I can't say what the "spackling buckets" are going to be used for but if just requires cleaning and is recyclable then many construction sites will recycle. In fact, the job might require that stuff to be recycled to qualify for certain certifications at the end of the job. These are related to green building certifications like Leed.
To answer for your supreme court ruling, probably referring to Greenwood vs California? That would not fly in WA state at least where *state* level laws would increase protections for residents and garbage is seen as inviolate insofar as searches by government employees without a court order. That doesn't discuss random people going through it though. So I'm not 100% if it's at the curb - still 100% illegal if it's on the person's property.
So while you're stealing stuff from a construction site and trying to justify it - you may still be breaking the law. I mean - you're definitely breaking the law by entering the property and taking trash. Possibly two laws involved there.

For anyone else, just say you are getting them from food establishments to stop these sheep from commenting back. I am totally for following the 'rules' but recycling theater and laws that supposedly help the environment, but hurt it, and tax pickers doing actual good, is complete bullshit.

A more durable bucket will just ensure your restriction does not collapse the bucket. The restriction is still there and more debris will make it into the vacuum.

Like I said, recycling is typically protected against theft because the city or utility that collects the recycling stands to make money. If it's in the recycling bin (whether it qualifies to be recycled or not) it's against the law where I am - regardless of where it's located ( the bin).
For construction sites they will clean and recycle anything they can if they're trying to qualify for Leed status - I know this from personal experience. It also gets inspected to see if it qualifies. Residential and business waste aren't handled the same.
Here, I'll just say this : if you want to ask the crew that's fine but otherwise, stay the hell out of construction sites.

However, the lids are those had a peel off tab/wrap around the lid base. After removed, the lid was no longer secure and air/water tight as the lip didn't go over the top of the bucket anymore...just flush around most of it. wasted a bag of pellets as they got moisture.
