1.ELIGIBILITY: THE WINSTON INSTANT WIN GAME AND SWEEPSTAKES (THE "PROMOTION") IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES (EXCLUDING RESIDENTS OF MASSACHUSETTS AND MICHIGAN) AND THE DISTRICT OF COLUMBIA WHO ARE SMOKERS 21 YEARS OF AGE OR OLDER AND REGISTERED MEMBERS OF WWW.WINSTONCIGARETTES.COM (THE "WEBSITE") IN GOOD STANDING AT TIME OF ENTRY ("ELIGIBLE PARTICIPANTS"). Eligible Participants must access the Website from anywhere in the fifty (50) United States or the District of Columbia at the time they enter. Participation in the Promotion constitutes participant's full and unconditional agreement to these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to this Promotion.
2.PROMOTION PERIOD: The Promotion begins at 12:00:00 AM Eastern Time ("ET") on March 1, 2017 and ends at midnight (11:59:59 PM) EDT on May 31, 2017 (the "Promotion Entry Period").
3.ENTRY REQUIREMENTS: To be eligible to play the Game, you must be a registered member on the Website. To become a registered member on the Website, you may register for free by visiting the Website, selecting "First Time Here?" and following the registration directions, including providing your electronic signature which certifies that you are a smoker and 21 years of age or older. Certification statements are subject to verification and may be confirmed through a third-party data source. Entries submitted by participants that Sponsor is unable to age verify may be void.
4. HOW TO ENTER: There are two (2) ways to enter the Sweepstakes. 1) Internet/wireless entry: The Promotion consists of an Instant Win Game and a Sweepstakes. To play the Instant Win Game and enter the Sweepstakes, go to the Website during the Promotion Entry Period. Eligible Participants will be required to log in with their email address and password. If you choose to enter the Promotion via a smartphone, iPad, or tablet (which is not necessary to enter the Promotion), standard carrier-specific wireless rates and all applicable taxes apply depending upon the entrant's wireless pricing plan. Other carrier-specific rates and applicable taxes may also apply in accordance with entrant's wireless customer agreements. Internet service providers' and wireless carriers' rate plans may vary, and you should contact your service provider for more information on rate plans and other charges that may apply to your use of the service.

After logging in to the Website and accessing the Promotion page, you may click on the "Games/Sweepstakes" tab. To play the Game, click on the "Click to Play" button to activate the Game. Each day during the Promotion Period, an image of a portion of a classic car will be displayed to you along with three (3) choices from which to choose the correct year and model of the car shown (an "Instant Win Play"). A correct answer may result in an Instant Win Prize. Wrong answers will not result in an Instant Win Prize. During the Promotion Entry Period, randomly selected times will be designated, and the first Eligible Participant who correctly answers an Instant Win Play in accordance with the online instructions and whose Instant Win Play is properly received and recorded by Sponsor's computer on or immediately after a randomly designated time will win an Instant Win Prize ("Instant Win Prize"), subject to verification and the Instant Win prize limits set forth in Section 5 below. If your screen displays an Instant Winner message, you are a winner of an Instant Win Prize, subject to verification and the Instant Win prize limits set forth in Section 5 below. If your screen does not display an Instant Winner message, you are NOT a winner of an Instant Win Prize. Instant Win Prizes will be shipped within approximately two (2) to five (5) business days of winner verification. For each Instant Win Play, the Eligible Participant will also receive one (1) entry ("Entry") into the random drawing for a chance to win a Sweepstakes prize and any entrant who correctly answers the question during their Instant Win Play will receive one (1) additional bonus entry into the random drawing (a "Bonus Entry"). See Section 5 of these Official Rules below for details about the random drawing and selection of the Sweepstakes prize winners. 2) Mail-in entry: Complete the Official Entry Form in the direct mail piece by confirming your name, address, and telephone number and signing your full legal name to certify that you are a smoker, 21 years of age or older, and send it to the address indicated to receive one (1) Entry into the random drawing for a chance to win a Sweepstakes prize. Mail-in entries must be postmarked by May 31, 2017, and received by June 7, 2017. Sponsor is not responsible for lost, late, misdirected, incomplete, stolen, damaged, illegible, or postage-due entries or mail. An original Official Entry Form must be used to enter the Sweepstakes via the mail-in method of entry; no copies or mechanical reproductions of entry forms will be accepted. All Official Entry Forms must be signed certifying that you are a smoker, 21 years of age or older.

All Instant Win Plays must be received and recorded during the Promotion Entry Period. LIMIT: One (1) Instant Win Play, One (1) Sweepstakes Entry per day, and one (1) Bonus Entry per day. LIMIT: One (1) mail-in Sweepstakes Entry per Promotion Period. The number of Instant Win Prizes available to be won will decrease during the Promotion Period as Instant Win Prizes are awarded and claimed. Sponsor's server is the official time-keeping device for this Promotion. For purposes of this Promotion, a "day" is defined as a twenty-four-hour time period beginning at midnight (12:00:00 AM) ET of a calendar day and ending at 11:59:59 PM ET on the same calendar day during the Promotion Entry Period. All entries must be received by midnight (11:59:59 PM) EDT on May 31, 2017.

If an Eligible Participant fails to execute an Instant Win Play on a given day for any reason, such Eligible Participant forfeits such Instant Win Play for that day. A given Eligible Participant's Instant Win Plays for one (1) day cannot be saved or combined with such Eligible Participant's Instant Win Plays for any other day; each day's Instant Win Plays by a given Eligible Participant is a separate and independent event. Further, different Eligible Participants cannot combine their Instant Win Plays in any way. Use of computer programs and other automatic means to submit an Instant Win Play more than once per day is prohibited. Any attempt by any person to submit more than one Instant Win Play per day using multiple/different registrations or any other methods will void all of that person's Instant Win Plays. Instant Win Plays that are incomplete, lost, late, misdirected, garbled, or improperly received for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion, or incompatibility at Sponsor's servers or elsewhere, are not eligible. Regardless of what appears on screen for Eligible Participants, the decisions of Sponsor and the Administrator as to whether a given Instant Win Play yields one (1) entry are final and binding in all respects.
5. RANDOM DRAWING/SELECTION OF SWEEPSTAKES WINNERS: All eligible Sweepstakes Entries received during the Promotion Entry Period will be combined, and one (1) Grand Prize winner and ten (10) First Prize winners will be selected in a random drawing from among all eligible Sweepstakes entries received. The random drawing will be conducted on or about June 14, 2017, by the Administrator, Arrowhead Promotion & Fulfillment Co., Inc., an independent judging organization whose decisions on all matters relating to this Promotion are final and binding in all respects. Potential winners will be notified by U.S. Mail, phone or email on or about June 21, 2017.

SWEEPSTAKES PRIZES AND THEIR APPROXIMATE RETAIL VALUE ("ARV") AND ODDS OF WINNING: Sweepstakes Prizes: One (1) Grand Prize: Sweepstakes Grand Prize winner may receive a Sponsor-specified classic automobile ("Vehicle"); maximum ARV is $75,000.00 including a cash payment in the form of a check made payable to the Grand Prize winner in the amount of $35,000.00 to assist with vehicle warranty purchase (where available on qualifying vehicles, to be determined by third party vintage vehicle warranty provider) and to help offset the burden of taxes associated with winning this prize. Vehicle will be offered from a selection of Sponsor determined vintage automobiles that are available from a Sponsor approved vintage automobile dealer or seller. Taxes are the sole responsibility of winner. The difference in value as stated herein and value at time of prize notification, if any, will not be awarded in cash or otherwise. Grand Prize winner must be a licensed driver and must present a current valid U.S. driver license and proof of insurance prior to taking possession of the Vehicle, failure to show same may result in Grand Prize forfeiture and selection of an alternate potential winner. Grand Prize winner is responsible for all associated fees including all title, license, insurance, registration, preparation, applicable taxes or fees, and other fees associated with Vehicle. All other costs not specifically stated herein as being awarded are the responsibility of Grand Prize winner. Title of the Vehicle will transfer to the Grand Prize winner upon acceptance of delivery of the Vehicle, which must take place no later than forty-five (45) days after Grand Prize winner verification, or the Vehicle may (in Sponsors' sole discretion) be automatically forfeited by the Grand Prize winner. Upon accepting delivery and transfer of title of the Vehicle, Grand Prize winner hereby acknowledges and agrees that neither Sponsor nor any other person associated with the distribution, development and execution of this Promotion and the Vehicle, or any of their respective affiliates, parent companies, subsidiaries, directors, officers, employees, and agents makes any warranties, representations or guarantees, express or implied, in fact or in law, relative to the use or enjoyment of the Vehicle, including, without limitation, its quality, mechanical condition, merchantability or fitness for a particular purpose. By accepting delivery and transfer of title, Grand Prize winner is accepting the Vehicle "as is." In the alternative, Grand Prize winner may elect to receive the prize in the form of a $40,000.00 check made payable to the Grand Prize winner. Grand Prize winner has ten (10) business days after prize notification to select the cash alternative in lieu of the Vehicle prize. In no case shall Grand Prize winner be awarded both the Vehicle prize and the cash alternative. Grand Prize ARV will not exceed $75,000.00. Ten (10) First Prizes (3) day, two (2) night trip ("Trip") for First Prize winner and one (1) guest ("Guest") to the major U.S. city of winner's choice from among the following locations: Las Vegas, NV; Hollywood, CA; or Miami, FL. Trip includes round-trip coach air transportation on a carrier of Sponsor's choice for First Prize winner and Guest from the major U.S. gateway airport nearest First Prize winner's residence (as determined by Sponsor in its sole discretion) to the First Prize winner's selected destination; two (2) nights double hotel accommodations at Sponsor-specified hotel; up to $1,000.00 of pre-paid and pre-arranged activities through Sponsor's travel agent; up to $1,000.00 toward a vintage car rental (subject to availability and First Prize winner qualifications; driver must be at least 25 years old to avoid additional "younger driver" fee, which winner is solely responsible if under the age 25)); and $750.00 spending money awarded to First Prize winner in advance of travel (all travel and activity arrangements are at Sponsor's sole discretion). ARV of First Prize: up to $7,500.00; actual retail value of First Prize depends on city/date/time of departure, air fare fluctuations, ground transportation, the particular activities selected by First Prize winner and approved by Sponsor, and estimated car rental fees. Any difference between the stated ARV and actual ARV will not be awarded. The First Prize winner acknowledges and agrees that if any alcohol is consumed by the First Prize winner and Guest, such alcohol consumption is at the sole discretion of the First Prize winner and Guest. Sponsor is not responsible for any cost or liability resulting from such alcohol purchases and/or consumption. First Prize winner's Guests must be twenty-one (21) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. Once a Guest is selected, he/she may not be substituted except in Sponsor's sole and absolute discretion. First Prize winners and Guests must execute liability/publicity releases prior to issuance of travel documents; all travel is at the risk of First Prize winner and Guests. Specific travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Reservations are subject to availability. Travel dates are subject to Sponsor approval. Travel must be completed by June 1, 2018. If, for any reason, a First Prize winner and/or his/her Guest misses the initial flight as scheduled to his/her destination, the First Prize winner will forfeit the First Prize. If, for any reason, the First Prize winner and/or his/her Guest is not present for the designated return flight, he/she is solely responsible for his/her return flight. If, for any reason, the First Prize winner and/or his/her Guest is not present for pre-arranged hotel/airport transfers and/or ground transportation, he/she is solely responsible for his/her hotel/airport transfers and/or ground transportation. If, for any reason, the First Prize winner and/or his/her Guest is not present for pre-arranged activities, meals, or other pre-arranged and/or pre-paid activities he/she is solely responsible for his/her meals, and unused or partially used pre-payments will not be awarded. The Trip is subject to all applicable hotel and airline policies, practices and procedures. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Sponsor assumes no responsibility for canceled, delayed, suspended, or rescheduled events (including but not limited to airline flights, ground transportation, or activities) or any acts or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers, or any other persons providing any Trip-related services or accommodations beyond Sponsor's control. In the event any First Prize winner resides within 250 miles of the destination they selected, he/she will receive ground transportation in lieu of airfare and any difference between the stated retail value and actual retail value will not be awarded. First Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, insurance, unspecified meals, unspecified ground transportation, phone calls, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the First Prize and all such expenses are the sole responsibility of the First Prize winner. First Prize winner is responsible for any air travel taxes and/or expenses, including applicable departure taxes or fees, inspection charges, and security charges. First Prize winner is responsible for obtaining the proper travel documentation (e.g. boarding passes, valid government issued photo ID) prior to travel. Once issued, tickets are nonrefundable and nontransferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted. Sponsor will not replace any lost, mutilated, or stolen tickets. First Prize winners are solely responsible for all fuel charges and fees for the rental car and will be required to enter into a separate car rental agreement with the car rental company as a condition of receiving the car rental as part of the prize. Full insurance coverage (liability and comprehensive), a valid drivers' license, and valid credit card are all required as a condition of the ability to receive the car rental portion of the First Prize.

All Grand and First Prize winners are solely responsible for all federal, state and local taxes. Prizes are not transferable. No prize substitution. Reporting and payment of any applicable federal, state and local taxes is the sole responsibility of each Grand and First Prize winner. All Grand and First Prize winners may be required to provide Sponsor with their Social Security numbers for tax purposes. The Internal Revenue Service requires Form 1099-MISC to be issued and filed for any recipient who receives a prize if the annual aggregate value of the prize received is $600 or more. Sponsor will issue a Form 1099-MISC to all Grand and First Prize winners for the total fair market value of prizes received.

Odds of winning an Instant Win Prize depend on whether or not the Instant Win Play corresponds with a randomly preselected winning time and date. Limit: One (1) Instant Win Prize per Eligible Participant. No more than two (2) total prizes per Eligible Participant will be awarded. Subsequent Instant Win Plays by a winner of an Instant Win Prize are not eligible to win another Instant Win Prize. However, subsequent Instant Win Plays are eligible to receive additional Sweepstakes Entries limited to one (1) Sweepstakes Entry per day and one (1) Bonus Entry per day during the Promotion Period.

All Instant Win Play, Grand Prize and First Prize Winners acknowledge that the Sponsor and Administrator of the Promotion, and their agents do not make, nor are they in any manner responsible for, any warranty or representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of a prize except that such prize shall be subject to manufacturer's standard warranty to the extent offered. Selection of Vehicle prize item, size, color and model will be at Sponsor's sole discretion. Any Vehicle prize images depicted in advertising and promotional materials may vary from the actual Grand Prize as any depiction of a prize is for illustrative purposes only. The trademarks associated with prizes are the property of their respective owners, who are NOT affiliated with this Promotion in any fashion whatsoever, and no endorsement is suggested or implied.
6.GENERAL CONDITIONS: By participating in the Promotion, (a) Eligible Participants agree that Sponsor, its parent, affiliates, subsidiaries, production and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents (collectively, the "Released Parties") are indemnified, released, and will be held harmless by Eligible Participants from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of any prize or Eligible Participant's participation in this Promotion or any Promotion-related activity; and (b) Winners grant (and agree to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor's authority the right to the use of Winner's name, photograph, likeness, voice, image, statements, and biographical information at any time or times for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide and on the World Wide Web, without review, notification, approval, or additional compensation, unless prohibited by law. All Eligible Participants are subject to age-verification and confirmation that they meet the eligibility criteria set forth in Section 1 above. Notwithstanding anything to the contrary in Section 4, an Eligible Participant is not a winner of any prize, even if a winning prize message or any other aspect of the Promotion should so indicate, unless and until the Eligible Participant's eligibility and the potential winning claim has been verified. Sponsor and Administrator will not accept screen shots or other evidence of winning in lieu of their validation process. Potential Sweepstakes Grand Prize winner and First Prize winners will be required to execute and return an Affidavit of Eligibility and Liability Release, and (where lawful), a Publicity Release and submit a copy of a valid government-issued photo identification document within ten (10) business days after prize notification in order to claim his/her prize. First Prize winners and Guest will be required to complete a Travel Release Form within ten (10) business days after notification of winner eligibility confirmation. If a potential Grand or First prize winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility/Liability and Publicity Release or provide any other requested information within the required time period (if applicable), or if a prize-winning notification letter or prize is returned as undeliverable or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, that prize will be forfeited and awarded to an alternate prize winner in a random drawing from among all remaining eligible entries received. If a potential Instant Win Prize winner cannot be contacted, or fails to provide any requested information within the required time period (if applicable), or if a prize-winning notification letter or prize is returned as undeliverable or if a potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, that Instant Win prize will be forfeited and at Sponsor's discretion, may be placed back into the Instant Win prize pool and assigned a new randomly preselected date and time for award, provided there is time remaining in the Promotion Entry Period. Sponsor reserves the right to award fewer than the stated number of Instant Win prizes in the event it is unable to confirm winners for all the Instant Win prizes within the Promotion Entry Period for any reason, in its sole discretion. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of Eligible Participants. By participating, Eligible Participants agree to be bound by the Official Rules and the decisions of Sponsor or Administrator, whose decisions in all matters relating to this Promotion are final and binding in all respects. All entries become the property of Sponsor and will not be acknowledged or returned.
7. Liability Limitations: The Released Parties are not responsible for lost, late, stolen misdirected, or non-delivered Instant Win Plays, entries, or emails, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, miscommunications, or failed computer, network, telephone, satellite, cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures, or difficulties, or other errors of any kind whether human, mechanical, electronic, or network, or the incorrect or inaccurate capture of Instant Win Plays, entries, or other information or the failure to capture or the loss of any such information. Released Parties are not responsible for any incorrect or inaccurate information, whether caused by Website users or by any equipment or programming associated with or utilized in this Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft, or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor, in its sole discretion, may prohibit individuals from participating in this Promotion and disqualify Instant Win Plays and/or Sweepstakes Entries if the individuals (1) attempt to enter the Promotion through any means other than as described in these Official Rules, (2) attempt to disrupt the Promotion or Website or circumvent the terms and conditions of these Official Rules or the Website in any way or (3) repeatedly show a disregard for these Official Rules or Website terms or act (a) in an unsportsmanlike manner or (b) with an intent to annoy, abuse, threaten or harass any other entrant or Sponsor. Sponsor's failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision. The Released Parties are not responsible for injury or damage to Eligible Participant's or any other person's computer related to or resulting from participating in this Promotion or downloading or copying materials from, or use of, the Website.

If, for any reason, the Promotion is not capable of being conducted as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion and randomly determine Instant Winners from eligible, non-suspect Instant Win Plays received prior to action being taken or as otherwise deemed fair and equitable by Sponsor. No more than the stated number of prizes will be awarded. If the number of awarded prizes equals the number of prizes offered, no additional prizes will be awarded or provided in connection with this Promotion. In the event more prize winner notifications are issued, or more winning claims are received, than the number of prizes set forth in Section 5 of these Official Rules due to computer, printing, seeding, human or other error or problem, a random drawing will take place from among all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules. Inclusion in such drawing shall be each Eligible Participant's sole and exclusive remedy under such circumstances. If a random drawing is required, it will be conducted by the Administrator who is independent from Sponsor and whose decisions shall be final. In no event will Sponsor be liable for more than the stated number of prizes stated in Section 5 of these Official Rules. Sponsor and the Released Parties reserve the right to correct typographic, clerical or printing errors in any Promotion materials (including, without limitation, these Official Rules and any Abbreviated Rules). Sponsor and the Released Parties are not responsible for any typographical or other errors in the printing of materials relating to this Promotion, the administration of the Promotion, or in any announcement relating to this Promotion, including such error as may give an erroneous indication that a prize has been won. Any inconsistencies between any advertising or other promotional announcements or any Abbreviated Rules and these Official Rules shall be resolved in favor of these Official Rules.

IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE WEBSITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS WEBSITE IS PROVIDED "AS-IS," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 8. BINDING ARBITRATION: The decisions of the Sponsor and the Administrator are final on all matters relating to the Promotion including, without limitation, the construction, validity, interpretation and enforceability of these Official Rules. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply North Carolina law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, or illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS SECTION SHALL BE IN THE USER'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS PROMOTION IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.

BY PARTICIPATING IN SPONSOR'S PROMOTION, EACH ELIGIBLE PARTICIPANT AND PRIZE WINNER AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEY'S FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ELIGIBLE PARTICIPANT OR PRIZE WINNER BE PERMITTED TO OBTAIN ANY AWARD FOR, AND EACH ELIGIBLE PARTICPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY OTHER DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ELIGIBLE PARTICPANT AND PRIZE WINNER'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND USER IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. 9.GOVERNING LAW & JURISDICTION: The Promotion Official Rules and the Promotion are governed by US law and are subject to all applicable federal, state, and local laws and regulations. All issues and questions concerning the printing, construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and the Sponsor in connection with the Promotion, shall be governed by and construed in accordance with the laws of the state of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of the state of North Carolina or any other jurisdiction that would cause the application of the laws of any jurisdiction other than the State of North Carolina), and any matters or proceedings which are not subject to arbitration as set forth in Section 8 of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the state of North Carolina, in the City of Greensboro.
10.USE OF INFORMATION: The information provided by Eligible Participants in connection with becoming a registered member of the Website may be used for Sponsor's internal purposes and to send information to Eligible Participants through mail or email about Sponsor's products. By registering on the Website, Eligible Participants agree to be added to the Sponsor's mailing distribution list. Eligible Participants may subsequently opt-out by calling toll-free 1-866-233-6527 or visiting the Website, clicking on the "Remove Me" link, and following the instructions under "How can I be removed from the Winston mailing list?" Please see the terms regarding Sponsor's use of personal information collected through the Website at Winstoncigarettes.com. If an Eligible Participant is selected as a winner, his or her information may also be included in a publicly-available winners' list.
