I would write to Woot (owned by Amazon), they should take care of you at least with a refund or maybe ask for a partial refund if they run out of stock. They're usually pretty good. All their stuff...

Batteries should have a three year warranty. Even if you don't have receipt, the date is stamped into the top of the case. If out of warranty, you have to open the case and swap out the dead...

I have both saws. Had this one, love it, but wanted the blade on the left. Bought the “worm drive” one. Barely use it. It is very heavy and elongated. Like notslow said, good for long rips and such...

It's a nice saw for sure. Keep in mind, the worm drive style can't be used one handed very easy. I think it's easier to hold a straight rip with it though.
