For two reasons:
1. The content of the cookies pieces is extremely low, and
2. Virtually EVERY cookies and cream flavored protein powder has sugar/HFCS no matter the brand (ON, MuscleTech, etc.).

im not defending hfcs, but i think what he means is that the amount of hfcs is pretty insignificant if its only in the cookie pieces.
