From now on in order to avoid situations like this you'll have to go to the phone retailer and check the person's account and make sure the device isn't still financed or under a 2 year contract.

This scenario doesn't make sense. Why would the bank give you the title if it's NOT paid off? I'm sure banks aren't stupid enough to give you the title with the intent that the owner is in the bank...
