eBay item sold need help!

So on eBay I recently sold a new, unlocked android phone. I stated in the description of the listing in bold, does not work with CDMA. Also I had said I would not take returns

Someone bought it (been on eBay for 7+yrs, 99.8% rating), and said he had Verizon while the package was in transit. I told him that it would not work on Verizon. He said then he does not want it and refused the delivery, I got the item back now, and he opened a claim saying, I lied when I put factory unlock in the title of the listing.


I told him I would refund him minus the shipping cost but he won't take that. I called eBay and they said I am right, and do not need to be worried.

This is where my concern comes in, I read online where other people had this issue and eBay decided to favor the buyer.

Has anyone been through something like this and can comment what they did or said to eBay? Please and thank you

Saying you don't take returns is like buying drugs from someone on the street and asking if their a cop. Ebay protects buyers just about 100% of the time, and they DO offer returns, no matter what you say in your listing. Unless it's sold As-is

I have no idea what you said, without being rude or anything .

I found the answer, this is a direct copy and paste from eBay.

"Generally, the buyer is responsible for accepting the item when it arrives. If the buyer refuses delivery, their claim is not eligible for the eBay Money Back Guarantee".

To clarify what the other poster was saying ... Rregardless of whether you take returns or not, eBay policy permits returns under certain circumstances and (e.g. item not as described). Policy also dictates that the seller pay for return shipping in such cases. Essentially, your "no returns policy would only apply in a limited set of circumstances, such as the buyer changing his mind. Now in this case, under eBay policy, eBay should find in your favor. However, eBay rarely sides with the seller. The key here will be getting this dimwit to acknowledge via PM that he rejected the item because it doesn't support CDMA and then pointing out to eBay that you explicitly stated such in the listing.

"The item isn t an authentic unlocked device. The listing was cleverly misleading. It stated unlocked but could only be used with gsm devices."

I called eBay and they said that this is buyers remorse and they will close the case in my favor.

The thing is since he refused delivery, and I got the item back. the person on the phone said I can keep the item and money which seems too good to be true. I will be recalling to confirm this.

Well at least they found in your favor. The buyer clearly doesn't understand what "unlocked" means. At this point the worst case is the buyer gets his money back, though he should foot the bill for shipping.

a lot of buyers on ebay doesnt read. there are also scammers too. try to cheat the sellers. hard to sell stuff on ebay cause of that and the ridiculous amount of fees.

can u tell us the name of the buyer so we can block that bidder?

Verizon 4G/LTE uses the GSM network. It uses SIM cards. There shouldn't have been any issue with the buyer and the phone as long as the phone uses SIM cards and the buyer didn't have some weird Verizon plan.
