  • You can claim up to 8 products without proof of purchase.
WHO IS INCLUDED IN THE SETTLEMENT?
All persons and entities in the United States who made retail purchases of Covered Products from September 7,
2010 to June 26, 2018. "Covered Products" means any Babyganics product, regardless of product line, scent, and/or unit
size, marketed and sold by the Defendants in the United States. More information about the Babyganics products involved
in the Settlement is available at the Settlement Website, www.babyganicssettlement.com, or by calling 1-888-332-0279.

WHAT DOES THE SETTLEMENT PROVIDE?
  • The Settlement provides for a Settlement Fund in the amount of $2,215,000.00 to pay
  • (1) Eligible Claims submitted by Settlement Class Members;
  • (2) Attorneys' Fees and Expenses;
  • (3) Notice and Claim Administration Expenses; and
  • (4) Any service Awards made by the Court to Plaintiffs. Settlement Class Members who timely submit valid Claim Forms are entitled to receive a cash payment from the Settlement.
  • The actual amount recovered by each Settlement Class Member will not be determined until after the Claim Period has ended and all claims have been calculated.

What is this lawsuit about?
The lawsuit alleges that the Defendants violated certain laws in marketing and sales of Babyganics Products, including the use of the terms "Babyganics" "mineral-based" and "natural." The Settlement of this lawsuit will also resolve claims relating to subsets of Babyganics Products labeled with the terms "plant-based," "tear-free," and "SPF 50+". Those claims were raised in the following cases: Machlan v. S.C. Johnson, Inc., Case No. CGC-17-557613 (Sup. Ct. CA), later removed on April 28, 2017 to the District Court of the Northern District of California, No. 3:17-cv-02442 (certain Babyganics pre-moistened wipes with "plant"-related labeling); Skeen v. KAS Direct, LLC, d/b/a/ Babyganics, No. 1:17-cv-04119 (S.D.N.Y.) (certain Babyganics products with "tear-free"-related labeling); and Carroll v. S. C. Johnson & Son, Inc., Case No. 1:17-cv-5828, (N.D. Ill.) (certain Babyganics and mineral-based sunscreen products with SPF 50+ labeling).

The Defendants deny any and all wrongdoing of any kind whatsoever, and deny any liability to Plaintiffs and to the Settlement Class.

Thanks, only ever purchased one of their products, lotion and it was terrible. The Aveeno class action is the one I'm currently going rounds with. They said unlimited product coverage with proofs of purchase and as soon as I produced receipts for 160+ products they tried to claim I filed multiple claims, then asked for more information, then claimed I duplicated the information they asked for. These class action lawsuits hate to pay out unless it's just pennies.

Class action suits typically benefit the lawyers. For this settlement, the lawyers will probably take $2,214,000.00 and the rest of us will receive coupons for 25 cents off up to 8 Babyganics products.

It's probably that the name babyganics leads people to believe that their products are organic, but they're not.

Just a heads up because this was my first experience with anything like this:

I was part of the Honest baby items class action lawsuit. I ordered direct from the website so I had overt documentation of all the products I bought (which was in the thousands as it was a few years and we used a lot of their products). I had to compile all the documentation of the receipts into one large file to send to the lawyer. I did so, and later received a response from the lawyers office claiming I had not provided the right documentation and had to respond within three days or so. So I ended up taking screen shots etc etc of all the receipts in order to document everything they asked for, put it into a .pdf and made sure I got everything in there as clear as I could. Probably took me around 5 or 6 hours all together to compile.

I looked forward to my big pay day (they referenced something like up to a few dollars per item if you had a receipt) and when the fateful day arrived, I took my eight bucks and got some coffee.

I only share this to clarify my experiences in this realm. I have seen people post about how these lawsuits benefits the lawyers, and I think that might be the case, so consider the effort before you take actions.
