1. Eligibility: Skoal Quality Time instant win game (the "Instant Win Game") is open only to legal residents of the fifty (50) United States and the District of Columbia (excluding Massachusetts and Michigan) who are tobacco consumers at least twenty-one (21) years old at the time of entry. Employees of U.S. Smokeless Tobacco Company, LLC, its parent, affiliates, subsidiaries, vendors, and advertising and promotion agencies (including, without limitation, HelloWorld, Inc.), as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Noncompliance with any of the above eligibility requirements will result in disqualification. The Instant Win Game is subject to all applicable federal, state and local laws and regulations and is void in Massachusetts, Michigan, outside the United States, and where prohibited. Participation in the Instant Win Game constitutes entrant's full and unconditional agreement to these Official Rules and Presenter's and Administrator's decisions, which are final and binding in all matters related to the Instant Win Game. Winning a prize is contingent upon fulfilling all requirements set forth herein. Presenter and Administrator reserve the right to verify the eligibility of winners.

3. Timing: The Instant Win Game begins on October 21, 2019 at or about 9:00:00 a.m. Eastern Time ("ET"), ends on December 15, 2019 at 11:59:59 p.m. ET (the "Promotion Period"), and consists of eight (8) weekly entry periods (each a "Weekly Entry Period"). Each Weekly Entry Period begins each Monday at 12:00:00 a.m. ET and ends the following Sunday at 11:59:59 p.m. ET, except for the first Weekly Entry Period, which shall begin on Monday, October 21, 2019 at or about 9:00:00 am ET and end on Sunday, October 27, 2019 at 11:59:59 p.m. ET. Administrator's computer is the official timekeeping device for this Instant Win Game.
4. How to Enter: To play the Instant Win Game, you must first become a registered user at https://www.skoal.com. If you are not a registered user, go to https://www.skoal.com and follow the instructions to register for free. When you register on https://www.skoal.com you will be assigned a unique 9-digit customer number (herein "CCN") and will select, or may be assigned, a user ID that will be associated with your account. By registering at https://www.skoal.com you agree to be added to the Skoal mailing list. Once you have registered, log on to https://www.skoal.com and click on the link to the "Skoal Quality Time" Instant Win Game page.
Each Weekly Entry Period, after proceeding to the Instant Win Game page, follow the instructions to select one of the three (3) provided virtual cans. The Instant Win Game results will be instantly displayed upon selection; however, potential winners are subject to verification and validation prior to receiving a prize. Potential winners of the Instant Win Game will be provided directions for validation. Prize limit is outlined in Section 5 below.
Limit: Each entrant may receive one (1) Instant Win Game play per day during the Promotion Period. Once an entrant is a potential winner of an Instant Win Game prize, he/she will not be able to play the Instant Win Game for the remainder of the applicable Weekly Entry Period. A "day" is defined as a 24-hour period between 12:00:01 a.m. ET and 11:59:59 p.m. ET, except the first day which begins at 9:00:00 a.m. ET and ends at 11:59 p.m. ET.
All potential winners are subject to verification before any prize will be awarded. Administrator is responsible for the functionality of the Instant Win Game. Normal Internet, phone and usage charges imposed by your online or phone service may apply. Any attempt by any entrant to obtain more than the stated number of plays by using multiple/different email addresses, devices, identities, registrations and logins, or any other methods will void that entrant's plays and that entrant may be disqualified.
Use of any automated system to participate is prohibited and will result in disqualification. Presenter is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any registration or play, the authorized account holder of the CCN used to register will be deemed to be the entrant or player. Email addresses will be used solely for win notification and not for entry. Potential winners may be required to show proof of being the authorized account holder of the winning CCN.

For All Prizes: Potential winners must provide a valid email address when requested in order to receive prize shipment notification. Terms and conditions of gift cards apply. The actual value of electronic prizes is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Any difference between the actual value and ARV listed herein will not be awarded. Number of prizes available will diminish as they are awarded. Odds of winning a prize depend on the number of eligible Instant Win Game plays divided by the number of prizes available. Prizes are non-transferable and no substitution or cash redemption will be made except as provided herein at the Presenter's sole discretion. Presenter reserves the right to substitute any listed prize for one of equal or greater value if the designated prize should become unavailable for any reason. Presenter will not replace any lost or stolen prizes or components of a prize. Winners are responsible for all federal, state and local taxes and fees associated with prize receipt and/or use. TOTAL ARV OF ALL PRIZES: $1,518,859.00. Limit: One (1) prize per Weekly Entry Period per entrant, up to three (3) prizes during the entire Promotion Period. Each entrant may not win the same prize more than once.
All prize details not specified herein (including, without limitation, the size, color, brand, and version) shall be determined by Presenter in its sole discretion. Winner acknowledges that the Released Parties (as defined below) have not made, nor are in any manner responsible or liable for, any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, merchantability, or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers' terms therefor, and winners agree to look solely to such manufacturers for any such warranty and/or guarantee.
6. Determination and Verification of Potential Winners: Administrator's decisions as to the administration and operation of the Instant Win Game and the verification of potential winners are final and binding in all matters related to the Instant Win Game. Receiving a prize is contingent upon compliance with these Official Rules. There will be thirty-five thousand six hundred (35,600) random, computer-generated winning times, one for each prize listed in Section 5, generated during the Promotion Period. If you are the first player to play the Instant Win Game at or after one of the randomly generated times, you will be a potential instant winner of the prize indicated. If a potential winner cannot be contacted, fails to provide any requested information within the required time period (if applicable), prize is returned as undeliverable, prize is undelivered based on missing information (including, but not limited to, a valid address and valid phone number), or in the event that he or she is disqualified for any reason, potential winner forfeits the prize. Entrants are responsible for keeping their contact information associated with their CCN current. Presenter is not responsible for any change in email or mailing address. In the event that a potential winner of a prize valued over $25 is disqualified for any reason, Presenter will award the applicable prize to an alternate winner by random drawing from among all remaining eligible plays. There will be five (5) alternate drawings after which the prize will remain unawarded. Unclaimed prizes valued at $25 or less will not be awarded. Prizes will be received 8-10 weeks after winner verification.
ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY ADMINISTRATOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE INSTANT WIN GAME. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED, AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. 7. Release: By receipt of any prize, winners agrees to release and hold harmless Presenter, Administrator, prize suppliers, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Instant Win Game or receipt or use or misuse of any prize, or any claim or cause of action based on publicity rights, defamation or invasion of privacy. The Released Parties are not responsible if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or terrorism.
8. Publicity: Except where prohibited by law, participation in the Instant Win Game constitutes winner's consent (which will be confirmed in writing upon request of Presenter) to Presenter's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional, advertising or other purposes, worldwide, in any media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration.
9. General Conditions: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS INSTANT WIN GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, PRESENTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Presenter will not be responsible for lost, late, damaged, misdirected or mutilated mail, misdirected email, or for any technical problems, faulty, lost, garbled, incomplete, incorrect or mistranscribed data transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with this Instant Win Game. Presenter is not responsible for malfunctions or breakdown of any network systems, unavailable service connections, lost, incomplete, faulty network connectivity of any kind, failures of any service providers, or any combination thereof, which may limit a person's ability to participate in this Instant Win Game. Proof of a winning Instant Win Game play will not be deemed to be proof of receipt by Presenter. Presenter reserves the right to suspend, cancel or modify the Instant Win Game, or any part of it, if it cannot be executed as planned for any reason including, but not limited to, if fraud or technical failures destroy the integrity of the Instant Win Game; or if a computer virus, bug or other technical problem corrupts the administration, security, or proper play of the Instant Win Game as determined by Presenter and/or Administrator, in their sole discretion. If the Instant Win Game is so cancelled or modified, Presenter will award prizes from among all eligible plays received prior to such action (assuming a sufficient number of plays are received) in a random drawing, and Presenter shall have no further obligation to any participant in connection with this Instant Win Game. Any use of robotic, automatic, programmed or the like methods of participation will void all such plays. Presenter and/or Administrator reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the participant fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Presenter's or Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Instant Win Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Instant Win Game; (4) technical or human error which may occur in the administration of the Instant Win Game or the processing of plays; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Instant Win Game or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another play in the Instant Win Game, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Presenter reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS INSTANT WIN GAME, INCLUDING THE WEBSITE ASSOCIATED WITH THIS INSTANT WIN GAME AND ALL PRIZES, ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 11. Dispute Resolution: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Instant Win Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for New York or an appropriate New York State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Instant Win Game, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE INSTANT WIN GAME SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING PLAY HAVE BEEN VERIFIED, AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. 7. Release: By receipt of any prize, winners agrees to release and hold harmless Presenter, Administrator, prize suppliers, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Instant Win Game or receipt or use or misuse of any prize, or any claim or cause of action based on publicity rights, defamation or invasion of privacy. The Released Parties are not responsible if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather, or terrorism.
8. Publicity: Except where prohibited by law, participation in the Instant Win Game constitutes winner's consent (which will be confirmed in writing upon request of Presenter) to Presenter's and its agents' use of winner's name, likeness, photograph, voice, opinions and/or hometown and state for promotional, advertising or other purposes, worldwide, in any media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration.
9. General Conditions: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS INSTANT WIN GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, PRESENTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Presenter will not be responsible for lost, late, damaged, misdirected or mutilated mail, misdirected email, or for any technical problems, faulty, lost, garbled, incomplete, incorrect or mistranscribed data transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with this Instant Win Game. Presenter is not responsible for malfunctions or breakdown of any network systems, unavailable service connections, lost, incomplete, faulty network connectivity of any kind, failures of any service providers, or any combination thereof, which may limit a person's ability to participate in this Instant Win Game. Proof of a winning Instant Win Game play will not be deemed to be proof of receipt by Presenter. Presenter reserves the right to suspend, cancel or modify the Instant Win Game, or any part of it, if it cannot be executed as planned for any reason including, but not limited to, if fraud or technical failures destroy the integrity of the Instant Win Game; or if a computer virus, bug or other technical problem corrupts the administration, security, or proper play of the Instant Win Game as determined by Presenter and/or Administrator, in their sole discretion. If the Instant Win Game is so cancelled or modified, Presenter will award prizes from among all eligible plays received prior to such action (assuming a sufficient number of plays are received) in a random drawing, and Presenter shall have no further obligation to any participant in connection with this Instant Win Game. Any use of robotic, automatic, programmed or the like methods of participation will void all such plays. Presenter and/or Administrator reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the participant fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Presenter's or Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Instant Win Game; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in cellular networks, phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Instant Win Game; (4) technical or human error which may occur in the administration of the Instant Win Game or the processing of plays; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Instant Win Game or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another play in the Instant Win Game, if it is possible. No more than the stated number of prizes will be awarded. 11. Dispute Resolution: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Instant Win Game or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for New York or an appropriate New York State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Instant Win Game, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
