Only valid for vehicles that at the time of service are 13 months or older and have not been serviced in the past 13 months. Must use Genuine Mercedes‑Benz Parts, Mercedes‑Benz StarParts, or Genuine Remanufactured Parts. Customer is responsible for all applicable taxes.

Maybe your dealer SA will let it go if you talk to them about it beforehand. It might depend on how close you are to your SA, though.
You can always try another dealership if there's one nearby. Typically the service records aren't in just one big database across all dealers and I doubt they'd know when your last service date was.
Also, the service section on your dealer's website may have some coupons. They change from time to time from oil changes to alignments and tires/wheels.
