On this kit LSA is qualified, I would not return the other but RIDGID does not do LSA on single batteries alone.
The other item I bought is not opened and well under my return period.

So in order to get LSA for Ridgid batteries, they must be purchased with a charger combo? Why do they do that?
I am not sure why they do that, I would prefer to keep my other 9ah battery if it also had LSA even if it was the same price as this combo without the charger but unfortunately ridgid isn't going to warrant it under their LSA unless you purchase it in a combo kit.
