What's the difference between OEM and well non-OEM?
Generally OEM is the opposite of a boxed processor. A boxed one comes in a pretty box with a cooler. An OEM one generally won't come with a cooler, but maybe a case sticker. It's the same processor though.
"The difference is the packaging and the warranty"
"Box CPUs come in a pretty box and have a warranty. If the CPU normally comes with a stock cooler, there will be one included in the box.
OEM/Tray CPUs come in a plastic tray, that's it. No warranty, no cooler (if applicable), just the processor in a plastic tray."
In the case of this product, the heatsink is not included. It's not a great loss, you can customize your cooling systems to your desires without adding the normally included heatsink to your pile of computer parts that may never be used. Sometimes going OEM is for the best, other times, not so much. At a glance, in this case, I would not mind.
However, it looks like all locations are OOS except MI and MN, and must pick up in store.

it was no improvement over the previous generation
The 10700k was on sale on Prime Day for $250. This is a better deal if you have the motherboard for it. I have a Z590, so I grabbed one of these to unlock my PCIE 4.0 capability.

12400 beats it in almost every benchmark and is cheaper
