I bought a couple of these titles about a year ago, and the bright white subtitles are burned into the picture. You can't switch it off.
So don't buy Criterions on iTunes if that's important to you.
Sometimes I need to watch without the subtitles, so these are useless for me.

Yes, "ownership" of digital items seems be be at the whim of the seller about how long you "own" it. I was trying to build up a digital library and ditch my physical stuff until I realized how often my purchased digital movies have disappeared. Moving back to physical media or just watch on Kanopy, Hoopla, Netflix or Prime.
