I suspect you'll just have to examine the model number when it arrives, I doubt Amazon's inventory tracking is that discriminating so you should be prepared to send it back if that's a deal breaker for you. However if they are on top of things that well the item details indicate model MRJ33LL/A.

It may be that Apple is free to keep selling it in international markets or maybe they've been slapped separately in the EU or who the fark knows. But the reason there's watches in the US that won't check blood O2 is because that's the only way they could get the import ban lifted. IIRC Mossimo opposed this too saying that the patent is violated by the hardware and it shouldn't be allowed to go forward (because they want the leverage for their negotiations) but Apple was allowed to go this route.
TL;DR there's no current indication Apple would disable this functionality for already sold devices and it's unlikely they would since that would just open them up to a class action lawsuit from customers; it's more likely they'd just pay the greenmail to license the patent but they're gonna fight that as long as they can first.
