Nope, not banned, "new" 9 and Ultra 2 have Blood Oxygen feature disabled. Apple lost the patent suit, and as a compromise the feature is disabled on new imports, but existing users can continue using it.

The SE2 does not have the Blood Oxygen technology, or ECG, so was never affected.

This is se2, not s9. Does not have blood oxygen sensor
