Shrinking & Inaccurate Restaurant Base
I foolishly used the PDF link and inKind website to check the restaurants. It's inaccurate. Download the inKind app, sign up for an account, and then decide if it's gonna be useful to you. The restaurant base is small.
What it is, is fairly small and slow to grow their list of restaurants, and works best in major metropolitan areas. If you don't live in a major city, you may want to consider passing on this deal.

1. InKind Pass is a paid subscription that gives you 20% back on all InKind restaurant bills. The "normal" InKind is no fee and free to join.
2. As others have stated, you can use InKind credit for the restaurant bill and the tax, but not the tip. That comes from the credit card you associated with the app.
3. As of right now, there are only 10 restaurants in Nashville, but they are GOOD restaurants, not some crappy need-the-business kind of restaurants (I'm looking at you Groupon). At least 4 of them I go to regularly (Bakersfield, Boqueria, City Winery, Electric Jane).
4. Unlike things like restaurant.com, you can combine paying with InKind with any other deal (Happy Hour, etc.). It's like paying in cash equivalent roughly.
5. It is incredibly easy to use the App - you tell the app what restaurant you are at, punch in the check number at the bottom of your check and it pulls up the check. You pay (including tip) and show the server. Done.
6. There are currently always lots of deals on TOP of the 40% off for the original credit, like most of the restaurants right now have 15% credit back, spend $75 get $25 credit back, etc. I've earned lots of credits and used them with no issues. I believe this is InKind buying market share, I don't expect this level of stacked discounts to last...

Honestly it's easy to use and worth it. They also often have offers that stack. Like $25 off $75. Etc. I maybe use it once every 2-3 months - but it's a good value and easy to use.

And do restaurants let you use it on take out orders? Or is it dine in only?

Check your credit card offers and of course number of stores and which stores as the app I feel has mostly high-end restaurants (dependent on location, I have a sample of 3 big cities) to see if this deal is any good.
New user? Yes: continue questions. No: stop. You should know whether to buy.
Do you live in SF or NYC? Yes: continue questions. No: stop, this is 90% not for you.
Do you like expensive restaurants or some mid range local chains? Yes: continue questions. No: stop. Likely not worth your time.
Check out the inKind restaurant list. See if it's for you. Grab the subscription if it makes sense. Then figure out if gift cards would be worth it for you.
Overall, this is worth the time if you live in nyc/sf, have a subscription for the 20% cash back, and like to have regular restaurants you go to.
I wish more high end steakhouses took this, but likely not going to. I'll keep using my stuff at the coffee shops.
