I don't believe there's any real way to "refurbish" an Apple Pencil, check out iFixit's teardowns of these. The whole thing must destroyed with small explosives just to see the battery, I haven't seen any evidence that there's a company out there able to replace one. In my experience the tiny battery is what wears out on these and either won't charge at all or needs recharging every few mins, making it unworkable.
I'd assume these are just used items, and hope you get one manufactured recently and returned due to the buyer getting the wrong one (easy mistake to make given Apple's insane lineup of ipads and Pencils with or without dongles etc). While I generally have excellent luck with Apple stuff, I did have two Pencils randomly quit working over the years.... but at $38 it's probably worth a gamble, and perhaps it's possible to figure out the manufacturing date based on the serial to see if you got a fresh one.
