Yes but it says docks are getting around that by just copying the protocol Nintendo's official dock uses. So several third party docks have updated their firmware to correctly mimic the official dock and get past Nintendo's block.

I had this and couldn't get it to work even after applying the recommended firmware update.

I was however able to get the $14 JEMDO dock cable working perfectly after applying the Hagibis firmware.
