Personally, I'm not interested in game-key cards. Not for me. I want to buy the game on the cart.

"You own the game" didn't and doesn't work for my 3DS digital game purchases I can no longer download. Game-key cards are not the same as owning the game. Game-key cards are a license to download the game from Nintendo's servers and play it.

You bought a new 3ds and want all your previous purchases to work on it? I kinda feel like that's on you but that's just my opinion.

Well if for some reason they can't access their legit purchases while at the same time others can just hack their 3DS to download anything they want then it doesn't seem like an unreasonable expectation.

Has that happened to you? Have any of your switch one downloads become unavailable? Or are we just playing the "what if" scenario game?

The user mentioned their 3DS library and that was what the discussion was about, not Switch. You just changing the platform potentially alters the present discussion as the Switch remains an active platform for now and has not reached end-of-life status, though to be fair what happens with the 3DS could (and likely will) one day extend to the Switch as well.

Is that true that you can't download previous content for 3ds? Nintendos own website says it is still available for previous purchases. I don't have first hand experience as I don't have digital purchases for my 3ds.
