YMMV, but everything I have bought has been new in box, previously shipped and returned.
The pair I received from VIPOutlet were missing the Apple packaging but did look like brand new. However, Apple lists the warrantee period started in late October so they had absolutely been activated previously. So the "New Open Box" description was a lie. They can't be "New" if they have been sold and activated prior to your purchase... this automatically qualifies them as "Used".
I took screen shots of the original listing and they match the description from the link above... Here is their verbiage word for word "New Damaged Box - Inventory is in Brand New, Unused & Fully Functional condition however the outer packaging will show signs of scuffs, dents, rips or may have also been repackaged. These products are fully warranted and are 100% brand new and guaranteed to be defect-free upon delivery."
They did activate with my account and pair with my devices without issue. They came w/ firmware from October but updated quickly, swapped between my iPhone / iPad / Mac like they should, etc.. all of which would not work with the counterfeits.
Also agree with the statements above that returns in this condition should be ~$150 or less.
