If you have Switch 1, just purchase Switch 2 version. You will get all the 3 items: Switch 1 version, upgrade pack, and Switch 2 version.
During purchase, it will warn you that no current system are compatible with this software. Just ignore the warning and purchase it.
Once purchased, go to the purchased games, click on the game and hit Load, select Switch 1 registered to your account, and hit load. It will work!

It's very Hades like but not quite as polished. Single player is kinda mid but multi player was a lot more fun (as happens with Turtles games).
That said, I was playing on PC and having someone join that was on the Switch version was flawless for us to co-op. Was really impressed by that.
I'd say worth it at this price and I'm tempted to buy a second copy.

Teenage Mutant Ninja Turtles, Splintered Fate is a Hades like action roguelite that shines most in co op, with couch play and cross platform multiplayer called out as especially fun. The low sale price makes the full game feel like the best value, and the Switch 2 purchase path appears to include the Switch 1 version and upgrade pack. It is also described as light enough for quick sessions and even playing in bed. The main knocks are that it is less polished and less varied than Hades, with some repetition in solo play.
Common Questions (5)
Yes. Buying the Switch 2 version reportedly grants the Switch 1 version plus the Switch 2 version and upgrade pack, and it can be loaded on a Switch 1 from the purchased games/Virtual Card menu. That makes the Switch 2 listing the better buy if you want access on both systems.
At this price it is widely described as a steal and a very low-risk buy, especially for fans of Hades-style roguelites or TMNT co-op. The main caveat is that it can feel repetitive and is not as polished or as deep as Hades.
Yes, the Switch 2 purchase can be used on Switch 1, and the game can be loaded from the purchased games or Virtual Card menu after ignoring the compatibility warning. If you want both versions available, the Switch 2 listing appears to include the Switch 1 version and upgrade pack.
Yes. It has couch co-op and cross-platform co-op, with 4-player cross-platform co-op mentioned, and several comments say multiplayer is the stronger way to play. One report says PC-to-Switch co-op worked flawlessly.
The Switch 2 upgrade pack is $2.49, but at this sale price the full digital game is often the better value. The full game can be cheaper than the upgrade path and may be the best deal if you do not already own the Switch 1 version.

If You Don't Own the Nintendo Switch Version
A Nintendo Switch 2 Edition, which includes both the Nintendo Switch version and Upgrade Pack, will be available for purchase.
EDIT: I dont own a Switch 2 but went ahead and bought that version but not clear whether I will be able to DL the switch 1 version or not, LOL
