I got in on a factory blemished table saw a couple of weeks back, and it was DEFINITELY blemished. Works fine, but it was not brand new.
Then you should tell the company and get the item you actually bought. "Factory blemished" and "used" are entirety different categories of product with entirely different rules for what is legally allowed to be sold. If you really did get a used item instead of an actual factory blemish (new but with cosmetic damage during manufacture) then seems far more likely you got a returned product that the previous owner scammed the company on the return by returning their old used one in place of the actual factory blemish. "Used" and "factory blemished" are as incompatible as "used" and "new". Your experience is one of actual fraud (if they sold it to you and knew what was inside), not an example of what a person should reasonably expect to happen.
