You have no guarantee except that Nintendo is committed to removing your ability to download the games you purchased with your money. They are literally telling you this.
IMO - when it comes to the sides of for or against this digital only future, if one is younger than the NES / SNES / Genesis generation, then one is more likely to accept a digital future because one does not have that gaming history that those of us who were around when the magic was written enjoy. And that makes me sad for future generations where ownership is nothing but a story told by elders to their naive children.
Note, this is not a read on you, I don't know you or your situation. This is a general observation of the generational differences I am witnessing when it comes to ownership. Did you work to earn your money? Did you exchange that money for a product? If so, you should own it. Permanently. Full stop. This should be the default position of every single person.
