b.The return is due to the buyer's personal reason (e.g., No Longer Needed)
c.The item has been opened
d.The product belongs to the following categories: VGA, HD, Motherboard (MB), TV, or Projector
The restocking fee may range between 0-15% at seller's discretion for any qualifying returns."
The fine print does help the buyer in this case, since it's technically NOT a TV as it lacks a tuner, this would fail part d. If the seller refutes that and wants to charge a restocking fee against their own policy, buyer would need to get Newegg's help and have them get involved, whether they help or not is anyone's guess. Personally, I'd rather buy from Newegg directly or at least a more established seller with a reputation to protect.
