If you want to transmit you do. And don't think you won't get caught if you don't get license de transit. The FCC has many locations across the United States and they actively look for people transmitting illegally on ham frequencies as well as other government frequencies.

No. It's 5W out in high power 1W in low power. That's pretty typical for 99% of handheld ham radios of this nature.

Technically these say walkie talkie which are FRS and don't need a license but I know the uv5r is actually a ham radio on 440mhz so license required

if you transmit on FRS at 1 watt, you don't need a license. For everything else, you do need a license to transmit.
