WalMart open box isn't really like Amazon warehouse where like new repackaged really means that. WalMart open box is the retail box wrapped with packing tape, with something inside.
And the shipping weights aren't even the same- so whomever is shipping these HAS to know that the box doesn't have a battery in it but they just don't care.

i have bought too many tools in-store with yellow stickers on them that have grass or mud all over
The quality varies a lot some thing: I got looked brand new in box never opened. And some were a bit rougher. Overall I have a ton of tools in the hypertough 12 and 12v lineup and they are all great. And buying open box made the investment extremely cheap.
Most of the tools they are selling are going for the cost of the battery.
Check out torq test channel for reviews on the impacts. Pretty crazy for the price and great for weekend warriors.
