Personally I think the 40L is on the smaller side for an adult. I wouldn't go under a 65L. I guess it'd depend on how long and how much gear you plan on taking.

Got my order. The tag on the bag says dimensions are 12.2 × 10.6 × 24.8. So you should be able to squeeze this in as a carry on (but not a personal item)
