Someone in one of the reviews on Amazon or HD said that problem went away when he used a 4 amp battery. Of course that makes it a lot heavier.

I don't know about their 3 years warranty on power tools but the 3 years warranty on a gas pressure washer was misleading. I used it a few times and the hose leaked. I called in for the warranty...
