Marshalls New Terrible Return Policy

Hey everyone,
I just wanted to give a heads up about a new policy being enforced whimsically by various Marshalls store managements. I buy all the time at Marshalls (like TJ Maxx or Ross) and when I went last week, I picked up (among other things) a pair of $100 mens shoes for my brother. There is a large sign by the front of the store (as in all Marshalls) explaining the return policy. 30 Days with receipt for money back. After 30 Days, you get store credit. If you lose the receipt so they give you the lowest ticketed price for that item. Which all in all is pretty fair. I got home and gave the shoes to my brother whom they did not fit properly. Long story short, I went back to the very same Marshalls store within the 30 day time frame and they refused to take the return claiming that they do not accept returns on "high dollar items" (ie, anything over $50). I spoke to the manager there at length saying nowhere does the sign indicate there is any limitations and I clearly would not have bought these shoes had I known! No-go. He refused the return and told me I can call the corporate store. Marshalls Corporate told me that the individual stores have the right to add and or edit the rules of the return policy EVEN THOUGH there is no specific mention on the posted sign in the store, and that basically it is my tough luck. Im out the $100 for the shoes, but i figured I would try to warn people and/or see if anyone else out there ran into a similar problem. Up until this point I have been a huge marshalls fan, probably spending upwards of $3K a year there, (yeah, I buy alot of cloths!), but this is a dealbreaker if I ever saw one.

Thanks for the heads up. Marshalls is a pretty big company to have such an unscrupulous policy.

You could call your states and/or TV consumer advocate. Marshalls will make a killing this season on unsuspecting consumers. It's one of those "it's not the money it's the principle" kind of thing.

I'm not a lawyer, but common sense tells me this is against the law. Obviously not worth the money to contact a lawyer, but it may worthwhile to threaten them with it. I would also file a complaint with the BBB, FTC, etc. At the very least, try and return them to a different Marshall's. By the way, Marshall's and TJ Maxx are the same company. One of them bought the other one many years ago (can't remember who bought whom).

I would think that if they told you one policy (via big signs) and then gave this suprise policy it is something you could argue with your credit card.

I am not sure where you are from but I would contact my local news station, FOX CBS ABC affiliate and let them know. They will investigate and run a story about it. Here in the Bay Area they do stories like this all the time!
That is super ridiculous or Marshalls!!!!

small claims court. take a pic of the sign in the store for evidence. 90% of the time, big companies like this never even show up in court and you get a default judgment for actual damages, ($100), your time, and the court costs. I'd say it's an easy $500 judgment in this particular case, given the facts as presented in the original post.

then contact your state attorney general, the better business bureau, and local county weights & measures office. Your city/county may also have ordinances that apply.

It really is empowering to take a small case like this to small claims court & win.


finally, as stated by another poster, if you paid by credit card , dispute the charge.
