You can, just cancel the Sprint line within 14 days, and Sprint will refund all service charges [sprint.com] (including any monthly recurring charges, activation fee, and all associated taxes and fees). I would recommend porting out the Sprint number quietly instead of calling Sprint to cancel because Sprint employees don't like people add and cancel lines to take advantage of deal like this. Porting out the number automatically cancels the line/account.

I had the same problem when Sprint had the Moto Z2 force on sale few months back. Says I'm not eligible to upgrade.
I don't care about Sprint...can I just pay to activate, and use on different network? I don't want Sprint service

It's an unlocked phone. You can use it on any carrier
so, is it $95 if I don't get refund from Sprint? no other fees
