Unless something has changed in the last few months, Nintendo eShop won't let you buy the games until you've logged into a Switch w your Nintendo account. I tried during the holiday 2019 season before I got my switch
The purchasing account must be associated with a Switch at time of purchase. You can buy codes from other retailers, but you cannot buy directly from the eShop any other way.

What is odd on my end is that I logged into a switch, & went into the eshop to avoid this issue. Then today this deal comes up & I still get that error code when trying to purchase from the webpage. is there anything else that needs to be done besides those steps to get rid of this restriction?

Correct. Have an account. I went to checkout and get a error that I need a linked Switched. Same price on STEAM as well.
