Can you provide link to tests. I could not find any for these masks, assuming they are Chengde GB2626-2019 masks.

To clarify the issue is they are trying to pass these mask off as NIOSH approved is the problem and reason enough for me to pass

This may be true, but they're not "counterfeit."

They're on this CDC list of non-NIOSH masks approved by the FDA for emergency use:

Over 95%

In other words, the company is shady for "misusing the test results" to market their product when they're not supposed to, but it's not that the effectiveness of the mask is bad or that they are counterfeit masks. They're just marketing against regulations.

the version in this "deal" hasn't been tested by CDC nor is it on the non-NIOSH mask approved list.

WOW. Thanks for sharing! I went to the link and it reads for this exact brand:

"Chengde Technology Co., Ltd. is misusing NIOSH test information regarding WWDOLL model CD9501B KN95 Foldable Protective Masks. The product package indicates it meets Chinese standard GB 2626-2019 and was submitted to NIOSH under an International Respirator Assessment request. It is being marketed using results from the assessment. As stated on the NIOSH website, these results are not to be used by manufacturers, distributors, suppliers, and importers to make claims about their products and/or to influence purchasers and cannot be used to make claims that the product meets NIOSH approval requirements. Chengde Technology Co., Ltd. is not a NIOSH approval holder or a private label holder. (2/18/2021)"
