There is also an option to file with ups as lost or do I try TW first, paypal 2nd and ups third?

Personally, I'd dispute through PayPal or credit card in that case. You paid, but never received it, should be easy. Payment company does the work of contacting them and should go in your favor unless they show evidence you received it. TW would probably be the first contact for most companies, but since their reps are lousy and they say refunds will take 30 days, that's not great. Contacting UPS would be my last choice, as you're dealing with the middle man and would likely be a runaround. Again, this is specific for the lost batch from the 14th. It would be different if it was an isolated lost package.

Btw if I with dispute with paypal/cc will TW ban my address for future purchases if though it was not my fault? I heard it might.

Yeah, their reps are pretty bad from what I've read. I remember seeing someone post that they successfully disputed a PayPal charge on a lost order and ordered again from them without a problem. It shouldn't be a problem as long as it's a legitimate issue like yours.

Many of the XR's weren't activated till mid/late Dec, that's why you aren't seeing reports yet.
There was a refurbished TF SE mentioned on another forum that was unlocked so should start seeing more reports soon.

They provided a Fedex tracking number and it's on the way back, but no idea what they might have done to it. If they reset so the screen serial is invalid or tore it apart and messed something up to check, I will be calling them and Apple.

For those who haven't received the item yet but want a refund, in case:

1/13 - Placed an order XR
1/14 - Received a tracking number / status is still as 'Label Created' (2/4)
1/24 - Contacted a higher level of CS (not a supervisor but I forgot the title), and received a case confirmation number
1/31 - Finally contacted a supervisor
2/4 - Received a refund
