OR, better yet, YOU are confused...The 40" is the length of the LEGS on these, NOT the waist size...

If Lightinthebox is a good commercial site, it should get its cert taken care of. I know if you acknowledge the warning and access probably be ok. But it is not worth the risk. Costco has a similar deal on Orvis brand pants a while ago. I don't mind spending a few more bucks just for the ease of the mind.
