You can have both.. 2 free nights, consider the extra you spend over the $49 one as your global entry bonus you get. When you have both, you get the benefit of 4th night free with the new one, and you retain the 10% back in points you get with the old one. I only book via points, and in 4 night blocks with the exception of my reward nights. You're leaving a lot on the table if you don't have em both.

Does free night counts towards first night of three night for 4th night free?

No, and the 4th night free & 10% back bonus only applies to points redemptions. You want to try & book via points, wait for point sales when they offer double bonuses. Not counting the 2% back I get from my Citi Double Cash, factoring the 10% back on redemptions, I average under half a penny per point. Another thing, some areas' taxes only apply when paying via currency, point redemptions get around taxes in some areas.

The terms say that you're not eligible if you have an IHG rewards card already. How would one be able to get both?

Don't upgrade, just apply for the new one to get the benefits of both. The reward point redemption benefits of both will stack together if you hold both cards. I'm not sure you understood my question. The terms specifically say that those who already have an IHG rewards card are not eligible for the product.

"This product is available to you if you do not have a current IHG® Rewards Credit Card and have not received a new Cardmember bonus within the last 24 months. This does not apply to Business Card Credit Card products."

If I have the $49 IHG Rewards Select card I read this to mean I'm not eligible to apply for the card. Your thoughts?

This could also be a great benefit for anyone affiliated with the military (Active Duty, Veteran, Retiree) as IHG is used for lodging on most Army bases.

I definitely understood it, that's why I said:

"unless they changed the terms/allowing them to stack, it's worth it if your situation warrants/justifies it."

And explained I'm proof of them being stackable unless something changed. I know they kept trying to get me to upgrade, I didn't. I and countless others just applied for the new one as new applicants and it worked. I believe mine was $89 when I got the second one, it's possible this new $99 one is slightly different but shares the same name. If it is, that sucks. I pay $140 in fees per year but that gets me 2 free nights each year plus global entry/TSA Pre. I also only book via points, I stock up when they go on sale for half a penny each, then I get 4th nights free plus 10% back. In May, I'm headed to Sacramento for a Jerry Cantrell show, I'm spending 4 nights at a Holiday Inn which comes out to $215 worth of points after my 10% back, then using one of my free nights to stay at the Kimpton Sawyer Hotel. I'd be afraid of the wording you see though, maybe applying for the $99 one will be considered an upgrade. If that's the case, the $49 one is better than the new one unless you see yourself using the 4th night free a couple times per year.

this is the info that used to be in the restrictions:

"This product is not available to either (i) current cardmembers of this credit card, or (ii) previous cardmembers of this credit card who received a new cardmember bonus for this credit card within the last 24 months."

That wording only applies to "this credit card" which is specifically talking about the premier, not the select. if the new wording has changed (I didn't check) from that to include the Select, or in general IHG credit cards as a whole, then doubling up probably isn't possible.
