Anyway online warranty purchasing didn't work. I called Apple Support. Gave them the AirPods serial number from my iPhone. They said the serial number had already been used in December 2022. I told them the packaging was brand new. There are 2 tear-off tabs with new AirPods box. Apple rep used the word "refurbished".
Tried returning the AirPods to local Target the next day. Told them about the serial number mismatch. Target rep rejected the return. They said they "traced" the packaging straight from Apple and it was "untouched".
I may be SOL since Red Card no longer has purchase protection.
I did additional research into fake AirPods on YouTube/Google. The fakes can really be convincing but in my case, it looks like the items are legit except for the mismatched serial numbers. Original box has a serial number which should match the MagSafe case serial number. While the left and right earbuds have their own serial numbers. When pairing my earbuds with my iPhone, another serial number came up. This serial number should have matched the original box and magsafe. It did not. I have 3 different serials number (original box, magsafe, Settings serial number) So far as I can tell, all the pieces (earbuds, original box, magsafe case) are legit, only things is that the serial numbers don't match up. This presents 2 main problems. 1) can't get AppleCare+ 2) some functionalities don't work like volume control on earbuds. Find My should allow you to send signal to make the MagSafe case beep which mine does not. There may be other things that don't work. I'm going to Apple Genius Bar tomorrow to have them verify that all the pieces are not fake. And to see if they can do anything for me but I'm not hopeful.
It appears there are other incidences where people have been scammed by Target.

TLDR, don't buy from Target using Red Card which does not have purchase protection.
*update* Apple Genius Bar confirmed everything is fake, earbuds and MagSafe case. I will be filing a police report so at least the next guy that gets scammed, hopefully they will get reimbursed. Again I want to reiterate how amazing these fakes are. Be careful out there people. Scrutinize your AirPods purchase.
*update 2* North Bergen Police met me at the North Bergen Target. I had the Apple Genius Bar report that showed that the Airpods were fake. Given that I was willing to get the police involved and that I had corroborating evidence from Apple Genius Bar, the local Target issued me a refund. In fact, one of the managers at the Target even said that this was the 2nd case that they had recently. I asked was it before or after my incident. He wouldn't say since he said there was an ongoing investigation. I'm pretty sure it was before my incident. Anyway personally I think it was one of the Target employees committing the scam but I didn't want to inflame the situation more by accusing anyone else.

Hoping they repeat again, I love my APP2 over version 1 and I am not having battery drain issue.

The Pro 2s have some improvements including a new gesture for volume control and improved noise cancelling (they handle loud noise like outdoor power equipment better)
Don't see headphones on there so lifetime it is.
edit:
nvm those were the gen 1 air pod pros for $129
My 2nd AirPods/case are fine.. dont want to spend $200 on another one
