Generally speaking when they do this sort of thing it's just to get around the manufactured minimum advertised price, they're new in box most of the time. However, the fact that there is no manufacturers warranty should give you pause unless you can buy an extended warranty as waiting for the 2yr refurbished eBay deals to come back is a much better long term option...

i purchased these in Feb of this year. I use them every day and fall asleep with them on most nights listening to a falling rain playlist with no issues. The XM5s have a different design from the XM3-XM4.
