The lawyers are right . It shifts the liability. If the person entering the site lies about their age then they are committing fraud against the site. At that point the entrant is engaging in unlawful activity —and the site technically is the victim of the fraud. Lying on the entry page is the same as lying on any application. The problem is that we're still talking about a child who isn't considered old enough to be responsible for themselves let alone entering into any legal agreements, so presenting such a minimal roadblock as a form of liability avoidance seems like something that could easily be shot down.

IANAL but I'm pretty sure this would come nowhere close to any legal definition of fraud.
