Regarding the S-Pen being included with the S22 Ultra trade in, I was just told by Order Support that you don't have to return the S-Pen regardless of their T&C. If you go to your "My Orders" and click "Get order help" (see screenshot), you can open a chat with someone more knowledgeable. They also gave me a Ticket Number documenting the conversation and assuring me it doesn't need to be returned.
That said, this is totally your decision/gamble/risk if you decide to not include the S-Pen. If you do want to take the risk, I suggest getting it documented and make sure to get a ticket number. We've all worked with Samsung support and they can be a pain in the butt.
