I think it depends on the captain of that cruise. Most captains won't allow ham radios on their cruises.
Baofeng UV-5R is way too old in 2023. Its chipset is read-only. You are stuck with a old fixed firmware, with all bugs there. Within the same $30 price range, Baofeng UV-5R is the worst choice. There are many faked Baofeng UV-5R in the market.
TYT TH-UV88, or Retevis RT85 is a better radio. And you can upgrade its firmware. And many batteries with USB-C ports fit it, e.g. BAOFENG GM-15, BL-13UV, Explorer QRZ-1, Radioddity GM-30. might be the same under different brands.
QUANSHENG UV-K5 is another better choice, and ppl have opened that firmware, and built many better versions, make it a nice receiver. UV-K5 has a USB-C charging port.
Anyway, a ham license will cost $50, $15 for the test, and $35 fee to FCC. And you have to learn for it.
It's not a bad deal if they are real. It would be a real slick deal if they included the programming cable. The photos don't show it so I wouldn't assume it comes with one.

Risk of getting caught is significantly higher when driving without a license, rather than operating a HAM radio without a license. If "need" a reference to risk management rather than strict adherence to the law, he is probably right. Just playing devil's advocate here...

Well, playing devil's advocate, one could argue the risk is significantly higher getting caught transmitting often on Ham bands because many are monitoring those frequencies and can and will report and find you through directional antennas, which cannot be done to locate those who drive without a license. There's no way to discern among all those driving on the road who has a license and who doesn't. And no one is actively monitoring the road for those without a driver's license.
The only way you would get caught driving without a license is if you are stopped for another driving violation. You could drive for years every day without a driver's license and never get caught. I doubt you could transmit constantly on Ham bands and not run into problems.
You can check the differences in penalties for driving without a license versus transmitting on radio bands without a license. Big difference.

Yes, why would you need a license to buy a car. You need to pass the driving exam and get a driver's license to drive but you don't need a license to buy a car.
How about microwaves, e-bikes, nail guns, drills and so on and so forth, perhaps we should license everything we own with the state?
